SYNOPSIS AS INTRODUCED:

    Amends the Downstate Police Article of the Illinois Pension Code. Provides that, at any time during the 6 months following the effective date of the amendatory Act, an active member of a downstate firefighters' pension fund may apply for transfer to that fund of up to 8 years of his or her creditable service accumulated in a police pension fund under the Downstate Police Article that is administered by a unit of local government if that active member was not subject to disciplinary action when he or she terminated employment with that police department. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by
5changing Section 3-110.12 as follows:
 
6    (40 ILCS 5/3-110.12)
7    Sec. 3-110.12. Transfer to Article 4 fund.
8    (a) At any time during the 6 months following the
9effective date of this Section, an active member of an Article
104 firefighters' pension fund may apply for transfer to that
11fund of up to 6 years of his or her creditable service
12accumulated in the police pension fund under this Article that
13is administered by the same unit of local government if that
14active member was not subject to disciplinary action when he
15or she terminated employment with that police department. The
16creditable service shall be transferred upon payment by the
17police pension fund to the Article 4 fund of an amount equal
18to:
19        (1) the amounts accumulated to the credit of the
20    applicant on the books of the fund on the date of transfer
21    for the service to be transferred; and
22        (2) employer contributions in an amount equal to the
23    amount determined under item (1); and

1        (3) any interest paid by the applicant in order to
2    reinstate service.
3    Participation in the police pension fund with respect to
4the transferred creditable service shall terminate on the date
5of transfer.
6    (a-5) At any time during the 6 months following the
7effective date of this amendatory Act of the 102nd General
8Assembly or the 6 months following the effective date of this
9amendatory Act of the 104th General Assembly, an active member
10of an Article 4 firefighters' pension fund may apply for
11transfer to that fund of up to 8 years of his or her creditable
12service accumulated in a police pension fund under this
13Article that is administered by a unit of local government if
14that active member was not subject to disciplinary action when
15he or she terminated employment with that police department.
16The creditable service shall be transferred upon payment by
17the police pension fund to the Article 4 fund of an amount
18equal to:
19        (1) the amounts accumulated to the credit of the
20    applicant on the books of the fund on the date of transfer
21    for the service to be transferred; and
22        (2) employer contributions in an amount equal to the
23    amount determined under item (1); and
24        (3) any interest paid by the applicant in order to
25    reinstate service.

1the transferred creditable service shall terminate on the date
2of transfer.
3    (b) At the time of applying for transfer of creditable
4service under this Section, an active member of an Article 4
5firefighters' pension fund may, for the purpose of that
6transfer, reinstate creditable service that was terminated by
7receipt of a refund, by payment to the police pension fund of
8the amount of the refund with interest thereon at the rate of
96% per year, compounded annually, from the date of the refund
10to the date of payment.

12    Section 90. The State Mandates Act is amended by adding
13Section 8.49 as follows:
 
14    (30 ILCS 805/8.49 new)
15    Sec. 8.49. Exempt mandate. Notwithstanding Sections 6 and
168 of this Act, no reimbursement by the State is required for
17the implementation of any mandate created by this amendatory
18Act of the 104th General Assembly.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
