Requires the issuance of a certificate upon completion of an anaphylaxis training program. Adds provisions regarding good Samaritan protections. Amends the Good Samaritan Act. Limits the liability of authorized individuals who may provide or administer an epinephrine injector.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Epinephrine Injector Act is amended by
5changing Sections 5 and 10 and by adding Section 25 as follows:

7    Sec. 5. Definitions. As used in this Act:
8    "Administer" means to directly apply an epinephrine
9injector to the body of an individual.
10    "Authorized entity" means any entity or organization,
11other than a school covered under Section 22-30 of the School
12Code, in connection with or at which allergens capable of
13causing anaphylaxis may be present, including, but not limited
14to, independent contractors who provide student transportation
15to schools, recreation camps, colleges and universities, day
16care facilities, youth sports leagues, amusement parks,
17restaurants, sports arenas, and places of employment. The
18Department shall, by rule, determine what constitutes a day
19care facility under this definition.
20    "Authorized individual" means an individual who has
21successfully completed the training program under Section 10
22of this Act.
23    "Department" means the Department of Public Health.

1    "Epinephrine injector" includes an auto-injector approved
2by the United States Food and Drug Administration for the
3administration of epinephrine and a pre-filled syringe
4approved by the United States Food and Drug Administration and
5used for the administration of epinephrine that contains a
6pre-measured dose of epinephrine that is equivalent to the
7dosages used in an auto-injector.
8    "Health care practitioner" means a physician licensed to
9practice medicine in all its branches under the Medical
10Practice Act of 1987, a physician assistant under the
11Physician Assistant Practice Act of 1987 with prescriptive
12authority, or an advanced practice registered nurse with
13prescribing authority under Article 65 of the Nurse Practice
14Act.
15    "Pharmacist" has the meaning given to that term under
16subsection (k-5) of Section 3 of the Pharmacy Practice Act.
17    "Undesignated epinephrine injector" means an epinephrine
18injector prescribed in the name of an authorized entity.

22    Sec. 10. Prescription to authorized entity; use; training.
23    (a) A health care practitioner may prescribe epinephrine
24injectors in the name of an authorized entity for use in
25accordance with this Act, and pharmacists and health care

1practitioners may dispense epinephrine injectors pursuant to a
2prescription issued in the name of an authorized entity. Such
3prescriptions shall be valid for a period of 2 years.
4    (b) An authorized entity may acquire and stock a supply of
5undesignated epinephrine injectors pursuant to a prescription
6issued under subsection (a) of this Section. Such undesignated
7epinephrine injectors shall be stored in a location readily
8accessible in an emergency and in accordance with the
9instructions for use of the epinephrine injectors. The
10Department may establish any additional requirements an
11authorized entity must follow under this Act.
12    (c) An employee or agent of an authorized entity who is an
13authorized individual or any other other individual who is an
14authorized individual has completed training under subsection
15(d) of this Section may:
16        (1) provide an epinephrine injector to any individual
17    on the property of the authorized entity whom the
18    employee, agent, or other individual believes in good
19    faith is experiencing anaphylaxis, or to the parent,
20    guardian, or caregiver of such individual, for immediate
21    administration, regardless of whether the individual has a
22    prescription for an epinephrine injector or has previously
23    been diagnosed with an allergy; or
24        (2) administer an epinephrine injector to any
25    individual on the property of the authorized entity whom
26    the employee, agent, or other individual believes in good

1    faith is experiencing anaphylaxis, regardless of whether
2    the individual has a prescription for an epinephrine
3    injector or has previously been diagnosed with an allergy.
4    (d) An employee, agent, or other individual authorized
5must complete an anaphylaxis training program before he or she
6is able to provide or administer an epinephrine injector under
7this Section. Such training shall be valid for a period of 2
8years and shall be conducted by a nationally recognized
9organization experienced in training laypersons in emergency
10health treatment. The Department shall include links to
11training providers' websites on its website.
12    Training shall include, but is not limited to:
13        (1) how to recognize signs and symptoms of an allergic
14    reaction, including anaphylaxis;
15        (2) how to administer an epinephrine injector; and
16        (3) a test demonstrating competency of the knowledge
17    required to recognize anaphylaxis and administer an
18    epinephrine injector.
19    Training may also include, but is not limited to:
20        (A) a review of high-risk areas on the authorized
21    entity's property and its related facilities;
22        (B) steps to take to prevent exposure to allergens;
23        (C) emergency follow-up procedures; and
24        (D) other criteria as determined in rules adopted
25    pursuant to this Act.
26    Training may be conducted either online or in person. The

1entity or individual conducting the training shall issue a
2certificate to each person who successfully completes the
3anaphylaxis training program. The Department shall approve
4training programs and list permitted training programs on the
5Department's Internet website.

8    Sec. 25. Good Samaritan protections. Any act or omission
9taken in good faith pursuant to this Act by any of the
10following entities or individuals shall be considered
11emergency care, advice, or assistance under the Good Samaritan
12Act: (i) an authorized entity that possesses and makes
13available epinephrine injectors and its employees or agents;
14(ii) an authorized individual who possesses, makes available,
15and administers epinephrine injectors; (iii) a pharmacy or
16manufacturer that dispenses epinephrine injectors to an
17authorized entity or authorized individual; or (iv) an
18individual or entity that conducts the training described in
19subsection (d) of Section 10 of this Act.
 
20    Section 10. The Good Samaritan Act is amended by adding
21Section 66 as follows:

1injectors. Any person meeting the definition of "authorized
2individual" under the Epinephrine Injector Act who acts in
3good faith to provide or administer epinephrine injectors
4pursuant to that Act, shall not, as a result of his or her acts
5or omissions, except willful and wanton misconduct on the part
6of that person, be liable to a person to whom such epinephrine
7injector is given to or administered for civil damages.
