105 ILCS 5/14-1.08a

    Amends the Children with Disabilities Article of the School Code. Provides that "separate public special education day school" does not mean any school in a school district that exceeds its Adequacy Target under the evidence-based funding formula. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-1.08a as follows:
 
6    (105 ILCS 5/14-1.08a)
7    Sec. 14-1.08a. Separate public special education day
8school. "Separate public special education day school" means a
9separate special education program or facility that is
10established by a school district, public school, regional
11office of education, or special education cooperative
12exclusively to meet the needs of special education students
13who cannot be educated in the general school environment and
14that provides services comparable to a private special
15education school. "Separate public special education day
16school" does not mean any school in a school district that
17exceeds its Adequacy Target, as calculated under subsection
18(b) of Section 18-8.15 of this Code.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
