| 1 | | AN ACT concerning education. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The School Code is amended by changing Section |
| 5 | | 14-1.08a as follows: |
| 6 | | (105 ILCS 5/14-1.08a) |
| 7 | | Sec. 14-1.08a. Separate public special education day |
| 8 | | school. "Separate public special education day school" means a |
| 9 | | separate special education program or facility that is |
| 10 | | established by a school district, public school, regional |
| 11 | | office of education, or special education cooperative |
| 12 | | exclusively to meet the needs of special education students |
| 13 | | who cannot be educated in the general school environment and |
| 14 | | that provides services comparable to a private special |
| 15 | | education school. "Separate public special education day |
| 16 | | school" does not mean any school in a school district that |
| 17 | | exceeds its Adequacy Target, as calculated under subsection |
| 18 | | (b) of Section 18-8.15 of this Code. |
