AMENDMENT TO HOUSE BILL 2504

2    AMENDMENT NO. ______. Amend House Bill 2504 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-400 and 3-413 and by adding Section
61-137.10 as follows:
 
7    (625 ILCS 5/1-137.10 new)
8    Sec. 1-137.10. License plate flipper. A device designed or
9adapted to be installed on a vehicle that by manual,
10electronic, mechanical, or other means alternates between 2 or
11more license plates or purported license plates or hides or
12conceals a license plate, making the license plate number not
13visible.

1registration plates, registration stickers or digital
2registration stickers, and drive-away permits; registration
3plate or digital registration plate covers.
4    (a) Registration plates or digital registration plates
5issued for a motor vehicle other than a motorcycle, autocycle,
6trailer, semitrailer, truck-tractor, apportioned bus, or
7apportioned truck shall be attached thereto, one in the
8frontmost and one in the rearmost. The registration plate or
9digital registration plate issued for a motorcycle, autocycle,
10trailer or semitrailer required to be registered hereunder and
11any apportionment plate issued to a bus under the provisions
12of this Code shall be attached to the rearmost thereof. The
13registration plate or digital registration plate issued for a
14truck-tractor or an apportioned truck required to be
15registered hereunder shall be attached to the frontmost
16thereof.
17    (b) Except for vehicles with rear loaded motorized
18forklifts, every registration plate or digital registration
19plate shall at all times be securely fastened in a horizontal
20position to the vehicle for which it is issued so as to prevent
21the plate from swinging and at a height of not less than 5
22inches from the ground, measuring from the bottom of such
23plate, in a place and position to be clearly visible and shall
24be maintained in a condition to be clearly legible, free from
25any materials that would obstruct the visibility of the plate.

1motorcycle may be mounted vertically as long as it is
2otherwise clearly visible. Registration stickers or digital
3registration stickers issued as evidence of renewed annual
4registration shall be attached to registration plates or
5displayed on digital registration plates as required by the
6Secretary of State, and be clearly visible at all times and
7displayed as prescribed in subsection (k). For those vehicles
8with rear loaded motorized forklifts, if the rear plate is
9securely fastened in a horizontal position as prescribed, the
10plate and registration sticker shall not be required to be
11clearly visible at all times as a result of the rear mounted
12motorized forklift obstructing the view.
13    (c) Every drive-away permit issued pursuant to this Code
14shall be firmly attached to the motor vehicle in the manner
15prescribed by the Secretary of State. If a drive-away permit
16is affixed to a motor vehicle in any other manner the permit
17shall be void and of no effect.
18    (d) The Illinois prorate decal issued to a foreign
19registered vehicle part of a fleet prorated or apportioned
20with Illinois, shall be displayed on a registration plate or
21digital registration plate and displayed on the frontmost of
22such vehicle in the same manner as an Illinois registration
23plate or digital registration plate.
24    (e) The registration plate or digital registration plate
25issued for a camper body mounted on a truck displaying
26registration plates or digital registration plates shall be

1attached to the rearmost of the camper body.
2    (f) No person shall operate a vehicle, nor permit the
3operation of a vehicle, upon which is displayed an Illinois
4registration plate or plates or digital registration plate or
5plates or registration stickers or digital registration
6stickers, except as provided for in subsection (b) of Section
73-701 of this Code, after the termination of the registration
8period for which issued or after the expiration date set
9pursuant to Sections 3-414 and 3-414.1 of this Code.
10    (g) A person may not operate any motor vehicle that is
11equipped with registration plate or digital registration plate
12covers. A violation of this subsection (g) or a similar
13provision of a local ordinance is an offense against laws and
14ordinances regulating the movement of traffic.
15    (h) A person may not sell or offer for sale a registration
16plate or digital registration plate cover. A violation of this
17subsection (h) is a business offense.
18    (i) A person may not advertise for the purpose of
19promoting the sale of registration plate or digital
20registration plate covers. A violation of this subsection (i)
21is a business offense.
22    (j) A person may not modify the original manufacturer's
23mounting location of any the rear registration plate or
24digital registration plate on any vehicle, nor shall any
25person or operator so as to conceal a vehicle's the
26registration or to knowingly cause it to be obstructed in an

1effort to hinder a peace officer from obtaining the
2registration for the enforcement of a violation of this Code,
3Section 27.1 of the Toll Highway Act concerning toll evasion,
4or any municipal ordinance or to circumvent plate detection
5systems. Modifications prohibited by this subsection (j)
6include but are not limited to the use of a license plate
7flipper an electronic device. A person may not purchase or
8possess, nor manufacture, sell, offer for sale, or otherwise
9distribute a license plate flipper. A violation of this
10subsection (j) is a Class A misdemeanor.
11    (k) Registration stickers issued as evidence of renewed
12registration by the Secretary shall be displayed on the upper
13right corner of the rear registration plate or in a manner
14otherwise provided by the Secretary. However, registration
15stickers issued to truck-tractors shall be displayed on the
16upper right corner of the front registration plate or in a
17manner otherwise provided by the Secretary.
18    (l) No person shall affix to any registration plate,
19temporary registration plate, digital registration plate,
20registration sticker, or other evidence of registration issued
21by the Secretary any medallion, insignia, tape, sticker, or
22other object not issued or approved by the Secretary. No
23person shall alter, manipulate, apply, or otherwise manipulate
24any evidence of registration issued by the Secretary in any
25manner from the original condition as was received when issued
26by the Secretary. It is unlawful to operate any vehicle that

1displays evidence of registration altered in any manner or
2displaying any medallion, insignia, sticker, or other object
3as prescribed in this subsection.
