| 1 | | AMENDMENT TO HOUSE BILL 2521

| 2 | | AMENDMENT NO. ______. Amend House Bill 2521 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Interscholastic Athletic Organization Act |
| 5 | | is amended by adding Section 1.3 as follows: |
| 6 | | (105 ILCS 25/1.3 new) |
| 7 | | Sec. 1.3. Criminal history records check. |
| 8 | | (a) An association or other entity that has, as one of its |
| 9 | | purposes, promoting, sponsoring, regulating, or in any manner |
| 10 | | providing for interscholastic athletics or any form of |
| 11 | | athletic competition among schools and students within this |
| 12 | | State shall require applicants for licensure as an official to |
| 13 | | authorize a fingerprint-based criminal history records check |
| 14 | | to determine if such applicants have been convicted of any |
| 15 | | disqualifying, enumerated criminal or drug offenses in |
| 16 | | subsection (c) or have been convicted, within 7 years of the |

| 1 | | application for employment with the school district, of any |
| 2 | | other felony under the laws of this State or of any offense |
| 3 | | committed or attempted in any other state or against the laws |
| 4 | | of the United States that, if committed or attempted in this |
| 5 | | State, would have been punishable as a felony under the laws of |
| 6 | | this State. |
| 7 | | Authorization for the check shall be furnished by the |
| 8 | | applicant to the association or entity, unless the applicant |
| 9 | | has previously authorized the check in a prior year's |
| 10 | | application through a school district, regional office of |
| 11 | | education, or such an association. The association or entity |
| 12 | | may require the applicant to furnish authorization for the |
| 13 | | check to the regional superintendent of the educational |
| 14 | | service region in which the applicant resides. Upon receipt of |
| 15 | | this authorization, the appropriate regional superintendent |
| 16 | | shall submit the applicant's name, sex, race, date of birth, |
| 17 | | social security number, fingerprint images, and other |
| 18 | | identifiers, as prescribed by the Illinois State Police, to |
| 19 | | the Illinois State Police. |
| 20 | | The regional superintendent submitting the requisite |
| 21 | | information to the Illinois State Police shall promptly notify |
| 22 | | the association or entity in which the applicant is seeking |
| 23 | | licensure as an official that the check of the applicant has |
| 24 | | been requested. The Illinois State Police and the Federal |
| 25 | | Bureau of Investigation shall furnish, pursuant to a |
| 26 | | fingerprint-based criminal history records check, records of |

| 1 | | convictions, forever and hereafter, until expunged, to the |
| 2 | | executive director for the association or entity that |
| 3 | | requested the check. The applicant may be charged a fee not to |
| 4 | | exceed the cost of the inquiry. |
| 5 | | (b) The association executive or the association |
| 6 | | executive's designee shall further perform a check of the |
| 7 | | Statewide Sex Offender Database, as authorized by the Sex |
| 8 | | Offender Community Notification Law, for each applicant. The |
| 9 | | check of the Statewide Sex Offender Database must be conducted |
| 10 | | by the association once every 5 years that an applicant |
| 11 | | remains licensed by the association. |
| 12 | | (c) The association executive or the association |
| 13 | | executive's designee shall further perform a check of the |
| 14 | | Statewide Murderer and Violent Offender Against Youth |
| 15 | | Database, as authorized by the Murderer and Violent Offender |
| 16 | | Against Youth Community Notification Law, for each applicant. |
| 17 | | The check of the Murderer and Violent Offender Against Youth |
| 18 | | Database must be conducted by the association executive or the |
| 19 | | association executive's designee once every 5 years that an |
| 20 | | applicant remains licensed by the association. |
| 21 | | Pending full clearance of all background check |
| 22 | | requirements, the prospective official must be supervised at |
| 23 | | all times by an individual who received a qualifying result on |
| 24 | | all background check components. |
| 25 | | Section 99. Effective date. This Act takes effect July 1, |
