AMENDMENT TO HOUSE BILL 2521

2    AMENDMENT NO. ______. Amend House Bill 2521 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Interscholastic Athletic Organization Act
5is amended by adding Section 1.3 as follows:
 
6    (105 ILCS 25/1.3 new)
7    Sec. 1.3. Criminal history records check.
8    (a) An association or other entity that has, as one of its
9purposes, promoting, sponsoring, regulating, or in any manner
10providing for interscholastic athletics or any form of
11athletic competition among schools and students within this
12State shall require applicants for licensure as an official to
13authorize a fingerprint-based criminal history records check
14to determine if such applicants have been convicted of any
15disqualifying, enumerated criminal or drug offenses in
16subsection (c) or have been convicted, within 7 years of the

1application for employment with the school district, of any
2other felony under the laws of this State or of any offense
3committed or attempted in any other state or against the laws
4of the United States that, if committed or attempted in this
5State, would have been punishable as a felony under the laws of
6this State.
7    Authorization for the check shall be furnished by the
8applicant to the association or entity, unless the applicant
9has previously authorized the check in a prior year's
10application through a school district, regional office of
11education, or such an association. The association or entity
12may require the applicant to furnish authorization for the
13check to the regional superintendent of the educational
14service region in which the applicant resides. Upon receipt of
15this authorization, the appropriate regional superintendent
16shall submit the applicant's name, sex, race, date of birth,
17social security number, fingerprint images, and other
18identifiers, as prescribed by the Illinois State Police, to
19the Illinois State Police.
20    The regional superintendent submitting the requisite
21information to the Illinois State Police shall promptly notify
22the association or entity in which the applicant is seeking
23licensure as an official that the check of the applicant has
24been requested. The Illinois State Police and the Federal
25Bureau of Investigation shall furnish, pursuant to a
26fingerprint-based criminal history records check, records of

1convictions, forever and hereafter, until expunged, to the
2executive director for the association or entity that
3requested the check. The applicant may be charged a fee not to
4exceed the cost of the inquiry.
5    (b) The association executive or the association
6executive's designee shall further perform a check of the
7Statewide Sex Offender Database, as authorized by the Sex
8Offender Community Notification Law, for each applicant. The
9check of the Statewide Sex Offender Database must be conducted
10by the association once every 5 years that an applicant
11remains licensed by the association.
12    (c) The association executive or the association
13executive's designee shall further perform a check of the
14Statewide Murderer and Violent Offender Against Youth
15Database, as authorized by the Murderer and Violent Offender
16Against Youth Community Notification Law, for each applicant.
17The check of the Murderer and Violent Offender Against Youth
18Database must be conducted by the association executive or the
19association executive's designee once every 5 years that an
20applicant remains licensed by the association.
21    Pending full clearance of all background check
22requirements, the prospective official must be supervised at
23all times by an individual who received a qualifying result on
24all background check components.
 
25    Section 99. Effective date. This Act takes effect July 1,
