| 1 | | AN ACT concerning business. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Consumer Fraud and Deceptive Business |
| 5 | | Practices Act is amended by adding Section 2HHHH as follows: |
| 6 | | (815 ILCS 505/2HHHH new) |
| 7 | | Sec. 2HHHH. Prohibit sale of self-administered sexual |
| 8 | | assault evidence collection kits. |
| 9 | | (a) As used in this Section: |
| 10 | | "Health care professional" and "sexual assault" have the |
| 11 | | meaning given to those terms in the Sexual Assault Survivors |
| 12 | | Emergency Treatment Act. |
| 13 | | "Self-administered sexual assault evidence collection kit" |
| 14 | | means materials advertised or marketed as a means for a |
| 15 | | person, other than a medical professional, to collect physical |
| 16 | | evidence of sexual assault. |
| 17 | | (b) It is an unlawful practice within the meaning of this |
| 18 | | Act for any person to sell, market, promote, advertise, or |
| 19 | | otherwise distribute a self-administered sexual assault |
| 20 | | evidence collection kit to a consumer in this State. |
