SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-20-22  from Ch. 24, par. 3.1-20-22

    Amends the Elected City Officers Division of the Municipal Code. Requires every municipality to stagger the terms of its alderpersons (rather than allowing municipalities to adopt a proposition to stagger the terms of its alderpersons). Provides that, if a municipality has not adopted a proposition to stagger the terms of alderpersons before the effective date of the amendatory Act, then at the next regular election for alderpersons one alderperson shall be elected from each even-numbered ward for a term of 2 years and one alderperson shall be elected from each odd-numbered ward for a term of 4 years and their successors shall be elected for terms of 4 years. Provides that the City of Chicago and the City of Chicago Heights are not required to stagger the elections of their alderpersons.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Section 3.1-20-22 as follows:
 
6    (65 ILCS 5/3.1-20-22)  (from Ch. 24, par. 3.1-20-22)
7    Sec. 3.1-20-22. Alderpersons; staggered terms.
8    (a) Every municipality shall stagger the terms of its
9alderpersons. In any city of less than 100,000 inhabitants, a
10proposition to stagger the terms of alderpersons, with as
11nearly as possible one-half of the alderpersons elected every
122 years, shall be certified by the city clerk to the proper
13election authority, who shall submit the proposition at an
14election in accordance with the general election law, if a
15petition requesting that action is signed by electors of the
16city numbering at least 10% of the total vote cast at the last
17election for mayor of the city and is filed with the city
18clerk.
19    The ballot shall have printed on it, but not as a part of
20the proposition submitted, the following information for
21voters: one alderperson elected from each even-numbered ward
22shall serve a term of 2 years; one alderperson elected from
23each odd-numbered ward shall serve a term of 4 years.

1    The proposition shall be substantially in the following
2form:
3        Shall (name of city) adopt a system of staggered terms
4    for alderpersons?
5    If a majority of those voting on the proposition vote in
6favor of it, then at
7    (b) If a municipality has not adopted has not adopted a
8proposition to stagger the terms of alderpersons before the
9effective date of this amendatory Act of the 104th General
10Assembly, then at the next regular election for alderpersons
11one alderperson shall be elected from each even-numbered ward
12for a term of 2 years and one alderperson shall be elected from
13each odd-numbered ward for a term of 4 years. Thereafter,
14their successors shall be elected for terms of 4 years.
15    (c) This Section does not apply to the City of Chicago or
16the City of Chicago Heights.
