AMENDMENT TO HOUSE BILL 2715

2    AMENDMENT NO. ______. Amend House Bill 2715 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Acupuncture Practice Act is amended by
5adding Section 95 as follows:
 
6    (225 ILCS 2/95 new)
7    Sec. 95. Exemption for practice of the 5-needle protocol.
8As used in this Section, "5-needle protocol" means a procedure
9where up to 5 needles are inserted into the external human ear
10to provide relief from the effects of behavioral health
11conditions.
12    None of the provisions of this Act shall prevent an
13appropriately trained person from engaging in a standardized
145-needle protocol if the person:
15        (1) has appropriate training in the 5-needle protocol,
16    including training established by the National Acupuncture

1    Detoxification Association or the People's Organization of
2    Community Acupuncture or similar training approved by the
3    Board;
4        (2) has appropriate training in clean needle
5    techniques;
6        (3) employs sterile, single-use needles, without
7    reuse;
8        (4) does not purport to treat any specific disease,
9    disorder, infirmity, or affliction;
10        (5) does not use any letters, words, or insignia
11    indicating or implying that the person is an
12    acupuncturist; and
13        (6) makes no statements implying that the person's
14    practice of the 5-needle protocol is licensed, certified,
15    or otherwise overseen by the State.
16    Treatment utilizing the 5-needle protocol pursuant to this
17Section shall be strictly limited to the insertion of
18disposable sterile acupuncture needles into, and limited only
19to, the ear and only in compliance with the 5-needle protocol.
20The application or insertion of needles anywhere else on the
21body of another person by a person acting under the provisions
22of this Section shall be considered engaging in the practice
23of acupuncture without a license.".
