| 4 | | "Section 5. The Environmental Protection Act is amended by |
| 5 | | adding Section 22.16c as follows:

| 7 | | Sec. 22.16c. Sanitary landfill fuel charges. The owner or |
| 8 | | operator of a sanitary landfill permitted or required to be |
| 9 | | permitted by the Agency under this Act shall not, by contract |
| 10 | | or otherwise, charge or assess residential or commercial |
| 11 | | customers, including companies that provide residential or |
| 12 | | commercial waste hauling services, a fee or surcharge that |
| 13 | | changes based on changes in the cost of motor fuel, as defined |
| 14 | | in Section 1.1 of the Motor Fuel Tax Law.". |
