AMENDMENT TO HOUSE BILL 3005

2    AMENDMENT NO. ______. Amend House Bill 3005, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 1, on page 61, immediately below line 10, by inserting the
5following:
 
6    "Section 26. The Prevailing Wage Act is amended by
7changing Section 3 as follows:
 
8    (820 ILCS 130/3)  (from Ch. 48, par. 39s-3)
9    Sec. 3. Not less than the general prevailing rate of
10hourly wages for work of a similar character on public works in
11the locality in which the work is performed, and not less than
12the general prevailing rate of hourly wages for legal holiday
13and overtime work, shall be paid to all laborers, workers, and
14mechanics employed by or on behalf of any public body engaged
15in the construction or demolition of public works. This
16includes any maintenance, repair, assembly, or disassembly

1work performed on equipment whether owned, leased, or rented
2and, notwithstanding any other provision of this Act, applies
3to field mechanics, technicians, or similar positions,
4including time spent transporting parts, materials, or
5equipment to and from a site, regardless of whether the person
6is employed by a contractor, subcontractor, seller, or
7supplier. Only such laborers, workers and mechanics as are
8directly employed by contractors or subcontractors in actual
9construction work on the site of the building or construction
10job, and laborers, workers and mechanics engaged in the
11transportation of materials and equipment to or from the site,
12but not including the transportation by the sellers and
13suppliers or the manufacture or processing of materials or
14equipment, in the execution of any contract or contracts for
15public works with any public body shall be deemed to be
16employed upon public works. The wage for a tradesman
17performing maintenance is equivalent to that of a tradesman
18engaged in construction or demolition.
