| 1 | | to that term in Section 2-101 of the Illinois Human Rights Act. |
| 2 | | (b) It is an unlawful practice within the meaning of this |
| 3 | | Act for any person to use a chatbot to engage in a commercial |
| 4 | | transaction or trade practice with a consumer in which: |
| 5 | | (1) the consumer is communicating or otherwise |
| 6 | | interacting with a chatbot that engages in a textual or |
| 7 | | aural conversation; |
| 8 | | (2) the communication may mislead or deceive a |
| 9 | | reasonable consumer to believe that the consumer is |
| 10 | | communicating with a human representative; and |
| 11 | | (3) the consumer is not notified in a clear and |
| 12 | | conspicuous manner that the consumer is communicating with |
| 13 | | a chatbot and not a human representative. |
| 14 | | (c) The disclosures required under paragraph (3) of |
| 15 | | subsection (b) shall be clear and conspicuous and reasonably |
| 16 | | designed to inform consumers that the consumer is |
| 17 | | communicating with a chatbot and not a human representative. A |
| 18 | | disclosure is not required if it would be obvious to a |
| 19 | | reasonable consumer that the consumer is communicating with a |
| 20 | | chatbot and not a human representative.". |
