SYNOPSIS AS INTRODUCED:

New Act

Creates the Access and Functional Needs Individual Registry Act. Directs the Secretary of State to establish the access and functional needs individual registry in consultation with local emergency management agencies, with certain requirements. Provides for privacy and security and the responsibilities of public safety partners. Requires annual reporting by the Secretary of State to the Governor and the General Assembly. Provides for funding and rulemaking. Declares a purpose and defines terms. Effective immediately.

A BILL FOR

AN ACT concerning safety.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Access and Functional Needs Individual Registry Act.

Section 5. Purpose. The purpose of this Act is to establish a statewide voluntary registry for access and functional needs individuals, in order to support effective planning and response efforts by public safety partners during emergencies and disasters.

Section 10. Definitions. In this Act:

"Access and functional needs individual" or "AFN individual" means an individual who may require additional assistance before, during, and after an emergency due to physical, sensory, mental health, cognitive, or intellectual disabilities; limitations related to age; chronic health conditions; or reliance on assistive technology, a service animal, or transportation assistance.

"Public safety partners" means agencies and organizations responsible for emergency management, including law enforcement, fire services, emergency medical services, emergency management agencies, and public health departments.

"Registry" means the access and functional needs individual registry, the voluntary statewide database that collects and maintains information on AFN individuals, accessible to public safety partners during emergency planning, response, and recovery, established by the Secretary of State under this Act or rules adopted under this Act.

Section 15. Establishment of the Registry.

(a) The Secretary of State, in consultation with local emergency management agencies, shall establish and maintain a centralized, secure, and voluntary statewide access and functional needs individual registry.

(b) The registry shall collect relevant information to identify AFN individuals' specific needs in emergency situations, including, but not limited to:

(1) the AFN individual's name;

(2) the contact information for the AFN individual;

(3) the primary residence of the AFN individual;

(4) the type of assistance needed by the AFN individual, such as mobility assistance, medical equipment, or transportation support;

(5) the emergency contact information for the AFN individual; and

(6) the consent by the AFN individual for data sharing with public safety partners.

(c) AFN individuals may voluntarily enroll in the registry through online platforms, local emergency management offices, healthcare providers, or non-governmental organizations. The Secretary of State may enter into agreements to implement this Section.

Section 20. Privacy and security.

(a) The information in the registry shall be confidential and used solely for emergency planning, response, and recovery.

(b) Access to the registry shall be limited to authorized personnel within the Secretary of State, local emergency management agencies, and other designated public safety partners.

(c) Strict data security measures shall be implemented to protect personal information from unauthorized access, breaches, or misuse.

(d) Participants may opt out of the registry or update their information at any time.

Section 25. Responsibilities of public safety partners.

(a) Public safety partners shall use the registry to enhance preparedness and response efforts for AFN individuals by:

(1) integrating registry data into local emergency operations plans;

(2) coordinating with healthcare providers and support services to address AFN needs during evacuations, sheltering, and disaster recovery; and

(3) conducting outreach and education to raise awareness of the registry.

(b) Local emergency management agencies shall be responsible for promoting the registry within their jurisdictions and collaborating with community organizations, including those serving individuals with disabilities, seniors, and other vulnerable populations.

Section 30. Reporting requirements. On or before January 1 of each year, beginning January 1, 2026, the Secretary of State shall submit an annual report to the Governor and the General Assembly on the operation of the Access and Functional Needs Individual Registry, including participation rates, outreach efforts, and any recommendations for improvements.

Section 35. Funding; rulemaking.

(a) The establishment and maintenance of the registry shall be funded through appropriations from the State's General Revenue Fund, federal grants, other sources designated for public safety, or any combination of those sources.

(b) The Secretary of State shall adopt rules implementing this Act.

Section 99. Effective date. This Act takes effect upon becoming law.
