| 1 | AN ACT concerning safety. | |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
| 3 | represented in the General Assembly: | |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Access | |||||||||||||||||||
| 5 | and Functional Needs Individual Registry Act. | |||||||||||||||||||
| 6 | Section 5. Purpose. The purpose of this Act is to | |||||||||||||||||||
| 7 | establish a statewide voluntary registry for access and | |||||||||||||||||||
| 8 | functional needs individuals, in order to support effective | |||||||||||||||||||
| 9 | planning and response efforts by public safety partners during | |||||||||||||||||||
| 10 | emergencies and disasters. | |||||||||||||||||||
| 11 | Section 10. Definitions. In this Act: | |||||||||||||||||||
| 12 | "Access and functional needs individual" or "AFN | |||||||||||||||||||
| 13 | individual" means an individual who may require additional | |||||||||||||||||||
| 14 | assistance before, during, and after an emergency due to | |||||||||||||||||||
| 15 | physical, sensory, mental health, cognitive, or intellectual | |||||||||||||||||||
| 16 | disabilities; limitations related to age; chronic health | |||||||||||||||||||
| 17 | conditions; or reliance on assistive technology, a service | |||||||||||||||||||
| 18 | animal, or transportation assistance. | |||||||||||||||||||
| 19 | "Public safety partners" means agencies and organizations | |||||||||||||||||||
| 20 | responsible for emergency management, including law | |||||||||||||||||||
| 21 | enforcement, fire services, emergency medical services, | |||||||||||||||||||
| 22 | emergency management agencies, and public health departments. | |||||||||||||||||||

| |||||||
| 1 | "Registry" means the access and functional needs | ||||||
| 2 | individual registry, the voluntary statewide database that | ||||||
| 3 | collects and maintains information on AFN individuals, | ||||||
| 4 | accessible to public safety partners during emergency | ||||||
| 5 | planning, response, and recovery, established by the Secretary | ||||||
| 6 | of State under this Act or rules adopted under this Act. | ||||||
| 7 | Section 15. Establishment of the Registry. | ||||||
| 8 | (a) The Secretary of State, in consultation with local | ||||||
| 9 | emergency management agencies, shall establish and maintain a | ||||||
| 10 | centralized, secure, and voluntary statewide access and | ||||||
| 11 | functional needs individual registry. | ||||||
| 12 | (b) The registry shall collect relevant information to | ||||||
| 13 | identify AFN individuals' specific needs in emergency | ||||||
| 14 | situations, including, but not limited to: | ||||||
| 15 | (1) the AFN individual's name; | ||||||
| 16 | (2) the contact information for the AFN individual; | ||||||
| 17 | (3) the primary residence of the AFN individual; | ||||||
| 18 | (4) the type of assistance needed by the AFN | ||||||
| 19 | individual, such as mobility assistance, medical | ||||||
| 20 | equipment, or transportation support; | ||||||
| 21 | (5) the emergency contact information for the AFN | ||||||
| 22 | individual; and | ||||||
| 23 | (6) the consent by the AFN individual for data sharing | ||||||
| 24 | with public safety partners. | ||||||
| 25 | (c) AFN individuals may voluntarily enroll in the registry | ||||||

| 1 | through online platforms, local emergency management offices, | ||||||
| 2 | healthcare providers, or non-governmental organizations. The | ||||||
| 3 | Secretary of State may enter into agreements to implement this | ||||||
| 4 | Section. | ||||||
| 5 | Section 20. Privacy and security. | ||||||
| 6 | (a) The information in the registry shall be confidential | ||||||
| 7 | and used solely for emergency planning, response, and | ||||||
| 8 | recovery. | ||||||
| 9 | (b) Access to the registry shall be limited to authorized | ||||||
| 10 | personnel within the Secretary of State, local emergency | ||||||
| 11 | management agencies, and other designated public safety | ||||||
| 12 | partners. | ||||||
| 13 | (c) Strict data security measures shall be implemented to | ||||||
| 14 | protect personal information from unauthorized access, | ||||||
| 15 | breaches, or misuse. | ||||||
| 16 | (d) Participants may opt out of the registry or update | ||||||
| 17 | their information at any time. | ||||||
| 18 | Section 25. Responsibilities of public safety partners. | ||||||
| 19 | (a) Public safety partners shall use the registry to | ||||||
| 20 | enhance preparedness and response efforts for AFN individuals | ||||||
| 21 | by: | ||||||
| 22 | (1) integrating registry data into local emergency | ||||||
| 23 | operations plans; | ||||||
| 24 | (2) coordinating with healthcare providers and support | ||||||
| |||||||
| |||||||
| 1 | services to address AFN needs during evacuations, | ||||||
| 2 | sheltering, and disaster recovery; and | ||||||
| 3 | (3) conducting outreach and education to raise | ||||||
| 4 | awareness of the registry. | ||||||
| 5 | (b) Local emergency management agencies shall be | ||||||
| 6 | responsible for promoting the registry within their | ||||||
| 7 | jurisdictions and collaborating with community organizations, | ||||||
| 8 | including those serving individuals with disabilities, | ||||||
| 9 | seniors, and other vulnerable populations. | ||||||
| 10 | Section 30. Reporting requirements. On or before January 1 | ||||||
| 11 | of each year, beginning January 1, 2026, the Secretary of | ||||||
| 12 | State shall submit an annual report to the Governor and the | ||||||
| 13 | General Assembly on the operation of the Access and Functional | ||||||
| 14 | Needs Individual Registry, including participation rates, | ||||||
| 15 | outreach efforts, and any recommendations for improvements. | ||||||
| 16 | Section 35. Funding; rulemaking. | ||||||
| 17 | (a) The establishment and maintenance of the registry | ||||||
| 18 | shall be funded through appropriations from the State's | ||||||
| 19 | General Revenue Fund, federal grants, other sources designated | ||||||
| 20 | for public safety, or any combination of those sources. | ||||||
| 21 | (b) The Secretary of State shall adopt rules implementing | ||||||
| 22 | this Act. | ||||||
| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
| 24 | becoming law. | ||||||
