AMENDMENT TO HOUSE BILL 3054

2    AMENDMENT NO. ______. Amend House Bill 3054 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Child Care Act of 1969 is amended by
5changing Section 5.8 as follows:
 
6    (225 ILCS 10/5.8)
7    (Text of Section before amendment by P.A. 103-594)
8    Sec. 5.8. Radon testing of licensed day care centers,
9licensed day care homes, and licensed group day care homes.
10    (a) Effective January 1, 2013, licensed day care centers,
11licensed day care homes, and licensed group day care homes
12shall have the facility tested for radon at least once every 3
13years pursuant to rules established by the Illinois Emergency
14Management Agency.
15    (b) Effective January 1, 2014, as part of an initial
16application or application for renewal of a license for day

1care centers, day care homes, and group day care homes, the
2Department shall require proof the facility has been tested
3within the last 3 years for radon pursuant to rules
4established by the Illinois Emergency Management Agency.
5    (c) The report of the most current radon measurement shall
6be posted in the facility next to the license issued by the
7Department. Copies of the report shall be provided to parents
8or guardians upon request.
9    (d) Included with the report referenced in subsection (c)
10shall be the following statement:
11        "Every parent or guardian is notified that this
12    facility has performed radon measurements to ensure the
13    health and safety of the occupants. The Illinois Emergency
14    Management Agency (IEMA) recommends that all residential
15    homes be tested and that corrective actions be taken at
16    levels equal to or greater than 4.0 pCi/L. Radon is a Class
17    A human carcinogen, the leading cause of lung cancer in
18    non-smokers, and the second leading cause of lung cancer
19    overall. For additional information about this facility
20    contact the licensee and for additional information
21    regarding radon contact the IEMA Radon Program at
22    800-325-1245 or on the Internet at
23    www.radon.illinois.gov.".
24    (e) On and after July 1, 2026, mitigation shall be
25required when testing confirms radon levels above 4.0 pCi/L.
26Mitigation shall be conducted according to industry standards

1and must be completed no later than 12 months after the testing
2confirms radon levels above 4.0 pCi/L. If radon test results
3are at or above 4.0 pCi/L and below 8.0 pCi/L, the licensed day
4care center, licensed day care home, or licensed group day
5care home shall create a corrective action plan that shall
6include long-term radon tests that show levels below 4.0
7pCi/L. If radon test results exceed 8.0 pCi/L, initial
8applicants shall mitigate before a license is issued and
9license renewal applicants shall close operations until the
10radon standard of 4.0 pCi/L or lower is achieved.

7    Section 95. No acceleration or delay. Where this Act makes
8changes in a statute that is represented in this Act by text
9that is not yet or no longer in effect (for example, a Section
10represented by multiple versions), the use of that text does
11not accelerate or delay the taking effect of (i) the changes
12made by this Act or (ii) provisions derived from any other
13Public Act.".
