SYNOPSIS AS INTRODUCED:
 
110 ILCS 70/36f  from Ch. 24 1/2, par. 38b5

    Amends the State Universities Civil Service Act. Removes language requiring applicants for examinations under the University System to be citizens of or residents in the State. Provides that an applicant offered employment on or after the effective date of the amendatory Act must reside within a reasonable distance from the applicant's designated university facility to perform onsite duties as required by the employer. Removes language providing that in examinations for technical positions for which no qualified residents of the State are available and for law enforcement personnel, the residence requirement may be waived.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Universities Civil Service Act is
5amended by changing Section 36f as follows:
 
6    (110 ILCS 70/36f)  (from Ch. 24 1/2, par. 38b5)
7    Sec. 36f. Examinations.
8    (a) All examinations given under the University System
9shall be open to all applicants who are citizens of or
10residents in the State of Illinois and who can qualify by
11training and experience for the position for which application
12is made. An applicant offered employment on or after the
13effective date of this amendatory Act of the 104th General
14Assembly must reside within a reasonable distance from the
15applicant's designated university facility to perform onsite
16duties as required by the employer. In examinations for
17technical positions for which no qualified residents of this
18State are available the residence requirement may be waived.
19In examinations for law enforcement personnel, the residence
20requirement shall be waived.
21    (b) Examinations may be written; oral; by statement of
22training and experience; in the form of tests of knowledge,
23skill, capacity, intellect, or aptitude; or by any other

1method which, in the judgment of the Merit Board, is
2reasonable and practical for any particular classification.
3The examinations shall be practical and shall relate to the
4classification for which the examination is given. No question
5in any examination shall relate to political or religious
6affiliation or racial origins of the examinee.
7    (c) Different examining procedures may be determined for
8the examinations in different classifications, but all
9examinations in the same classification must be uniform. The
10examination requirement for the initial appointment, entry
11level position only, of law enforcement personnel may be
12waived if an applicant has satisfied all the requirements
13established by the Illinois Police Training Act for
14appointment of law enforcement officers and if the Merit Board
15allows for such a waiver by rule. Additional positions, entry
16level only, may have the examination requirement waived if the
17occupational standards are regulated by the Department of
18Financial and Professional Regulation, as designated by the
19Merit Board and provided for in adopted rules.
