AMENDMENT TO HOUSE BILL 3062

2    AMENDMENT NO. ______. Amend House Bill 3062 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Universities Civil Service Act is
5amended by changing Section 36f as follows:
 
6    (110 ILCS 70/36f)  (from Ch. 24 1/2, par. 38b5)
7    Sec. 36f. Examinations.
8    (a) All examinations given under the University System
9shall be open to all applicants who are citizens of or
10residents in the State of Illinois and who can qualify by
11training and experience for the position for which application
12is made.
13        (1) From the date an employer begins a search in
14    earnest for a candidate who is qualified pursuant to this
15    Act and for the first 6 months of the employer's active and
16    continuous search thereafter, the employer shall consider

1    only applicants who are residents of Illinois and shall
2    select a qualified Illinois candidate whenever possible in
3    consideration of the needs of the employer.
4        (2) No applicant who resides outside of Illinois is
5    eligible for employment within the first 6 months of an
6    employer's active and continuous search. Thereafter, the
7    out-of-state resident's examination may be scored and the
8    out-of-state resident may be added to a register and
9    considered for employment pursuant to this Act. Any
10    candidate appointed to a civil service position pursuant
11    to this subsection (a) shall have 90 days from the
12    successful completion of the candidate's probationary
13    period to establish residence within Illinois or within 60
14    miles of the campus location at which the candidate is
15    employed.
16        (3) For classes within the professional,
17    semi-professional, or managerial occupational areas for
18    which a broader recruitment base is typically applied,
19    out-of-state residents may be admitted to the examination
20    and equally considered without regard to paragraphs (1)
21    and (2). If the Illinois residency requirement is waived,
22    these out-of-state candidates must establish Illinois
23    residency within 180 calendar days after any employment
24    offer or final appointment.
25        (4) In examinations for technical positions for which
26    no qualified residents of this State are available the

1    residence requirement may be waived.
2        (5) In examinations for law enforcement personnel, the
3    residence requirement shall be waived.
4    (b) Examinations may be written; oral; by statement of
5training and experience; in the form of tests of knowledge,
6skill, capacity, intellect, or aptitude; or by any other
7method which, in the judgment of the Merit Board, is
8reasonable and practical for any particular classification.
9The examinations shall be practical and shall relate to the
10classification for which the examination is given. No question
11in any examination shall relate to political or religious
12affiliation or racial origins of the examinee.
13    (c) Different examining procedures may be determined for
14the examinations in different classifications, but all
15examinations in the same classification must be uniform. The
16examination requirement for the initial appointment, entry
17level position only, of law enforcement personnel may be
18waived if an applicant has satisfied all the requirements
19established by the Illinois Police Training Act for
20appointment of law enforcement officers and if the Merit Board
21allows for such a waiver by rule. Additional positions, entry
22level only, may have the examination requirement waived if the
23occupational standards are regulated by the Department of
24Financial and Professional Regulation, as designated by the
25Merit Board and provided for in adopted rules.
