AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Illinois Health and Safety in Cosmetology and Barbering Products Disclosure Act.

Section 5. Definitions. In this Act:

"Barber" means any person licensed under the laws of Illinois to practice barbering. "Barber" includes "licensed barber" as that term is used in the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985.

"Beauty supply retailer" means any business, including beauty salons, barber shops, or retail stores, that sells personal care and beauty products, including hair care, skincare, and makeup products.

"Chemical products" means any cosmetic, hair care, skincare, or personal grooming product used or sold by cosmetologists, barbers, or beauty supply retailers that contains ingredients known to have potential health risks such as carcinogenic, reproductive, or endocrine-disrupting effects.

"Cosmetologist" means any person licensed under the laws of Illinois to practice cosmetology, esthetics, or nail technology. "Cosmetologist" includes "licensed cosmetologist", "licensed esthetician", and "licensed nail technician" as those terms are used in the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985.

"Health risks" means risks to human health that include, but are not limited to, cancer, birth defects, reproductive harm, skin irritation, endocrine disruption, and other long-term health effects as identified by the U.S. Environmental Protection Agency, the U.S. Food and Drug Administration, or other authoritative health organizations.

Section 10. Posting of health risk information.

(a) All cosmetologists, barbers, and beauty supply retailers operating within the State of Illinois shall display a visible and easily readable notice in a prominent location within their business establishment that provides information on the potential health risks associated with the chemical products contained in the products they use or sell.

(b) The posted notice must include, at a minimum, the following:

(1) A statement that some products may contain chemicals known to cause harm to human health.

(2) A list of common chemicals or ingredients found in beauty and personal care products, including formaldehyde, phthalates, parabens, and toluene, and their associated health risks.

(3) A reference to resources where customers can access more detailed information, including the website of the Illinois Department of Public Health and other relevant health organizations.

(c) The posted notice must be at least 11 inches by 14 inches in size, placed in a visible location near the reception area or other commonly accessed areas of the business where customers can easily read the notice. The font size must be large enough to be legible from a reasonable distance.

(d) The Illinois Department of Public Health shall develop a posted notice that complies with this Section and make that notice available for download as a printable document on its Internet website.

Section 15. Pamphlet distribution.

(a) At the point of sale, all cosmetologists, barbers, and beauty supply retailers must provide each customer with a pamphlet containing the same information detailed in Section 10. This pamphlet must be provided to customers for any service involving the use of beauty or personal care products.

(b) The pamphlet must include:

(1) A brief description of the potential health risks associated with chemicals commonly used in beauty products.

(2) A list of specific ingredients commonly found in products such as hair relaxers, hair dyes, nail polishes, and other personal care items, along with their known or suspected health effects.

(3) Contact information for the Illinois Department of Public Health and other trusted resources for additional information.

(c) The Department of Public Health shall develop a pamphlet that complies with this Section and make that pamphlet available for download as a printable document on its Internet website.

Section 20. Compliance and enforcement.

(a) The Illinois Department of Public Health shall be responsible for monitoring compliance with this Act. The Department may inspect beauty supply retailers, barbershops, and salons to ensure that health risk information is properly posted and pamphlets are distributed in accordance with this Act.

(b) A cosmetologist, barber, or beauty supply retailer found to be in violation of the provisions of this Act is guilty of a petty offense.

(c) The requirements of this Act do not apply to individuals or businesses who do not sell or use chemical products in the course of their operation.
