| 1 | | AN ACT concerning health. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 1. Short title. This Act may be cited as the |
| 5 | | Illinois Health and Safety in Cosmetology and Barbering |
| 6 | | Products Disclosure Act. |
| 7 | | Section 5. Definitions. In this Act: |
| 8 | | "Barber" means any person licensed under the laws of |
| 9 | | Illinois to practice barbering. "Barber" includes "licensed |
| 10 | | barber" as that term is used in the Barber, Cosmetology, |
| 11 | | Esthetics, Hair Braiding, and Nail Technology Act of 1985. |
| 12 | | "Beauty supply retailer" means any business, including |
| 13 | | beauty salons, barber shops, or retail stores, that sells |
| 14 | | personal care and beauty products, including hair care, |
| 15 | | skincare, and makeup products. |
| 16 | | "Chemical products" means any cosmetic, hair care, |
| 17 | | skincare, or personal grooming product used or sold by |
| 18 | | cosmetologists, barbers, or beauty supply retailers that |
| 19 | | contains ingredients known to have potential health risks such |
| 20 | | as carcinogenic, reproductive, or endocrine-disrupting |
| 21 | | effects. |
| 22 | | "Cosmetologist" means any person licensed under the laws |
| 23 | | of Illinois to practice cosmetology, esthetics, or nail |

| 1 | | technology. "Cosmetologist" includes "licensed |
| 2 | | cosmetologist", "licensed esthetician", and "licensed nail |
| 3 | | technician" as those terms are used in the Barber, |
| 4 | | Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act |
| 5 | | of 1985. |
| 6 | | "Health risks" means risks to human health that include, |
| 7 | | but are not limited to, cancer, birth defects, reproductive |
| 8 | | harm, skin irritation, endocrine disruption, and other |
| 9 | | long-term health effects as identified by the U.S. |
| 10 | | Environmental Protection Agency, the U.S. Food and Drug |
| 11 | | Administration, or other authoritative health organizations. |
| 12 | | Section 10. Posting of health risk information. |
| 13 | | (a) All cosmetologists, barbers, and beauty supply |
| 14 | | retailers operating within the State of Illinois shall display |
| 15 | | a visible and easily readable notice in a prominent location |
| 16 | | within their business establishment that provides information |
| 17 | | on the potential health risks associated with the chemical |
| 18 | | products contained in the products they use or sell. |
| 19 | | (b) The posted notice must include, at a minimum, the |
| 20 | | following: |
| 21 | | (1) A statement that some products may contain |
| 22 | | chemicals known to cause harm to human health. |
| 23 | | (2) A list of common chemicals or ingredients found in |
| 24 | | beauty and personal care products, including formaldehyde, |
| 25 | | phthalates, parabens, and toluene, and their associated |

| 1 | | health risks. |
| 2 | | (3) A reference to resources where customers can |
| 3 | | access more detailed information, including the website of |
| 4 | | the Illinois Department of Public Health and other |
| 5 | | relevant health organizations. |
| 6 | | (c) The posted notice must be at least 11 inches by 14 |
| 7 | | inches in size, placed in a visible location near the |
| 8 | | reception area or other commonly accessed areas of the |
| 9 | | business where customers can easily read the notice. The font |
| 10 | | size must be large enough to be legible from a reasonable |
| 11 | | distance. |
| 12 | | (d) The Illinois Department of Public Health shall develop |
| 13 | | a posted notice that complies with this Section and make that |
| 14 | | notice available for download as a printable document on its |
| 15 | | Internet website. |
| 16 | | Section 15. Pamphlet distribution. |
| 17 | | (a) At the point of sale, all cosmetologists, barbers, and |
| 18 | | beauty supply retailers must provide each customer with a |
| 19 | | pamphlet containing the same information detailed in Section |
| 20 | | 10. This pamphlet must be provided to customers for any |
| 21 | | service involving the use of beauty or personal care products. |
| 22 | | (b) The pamphlet must include: |
| 23 | | (1) A brief description of the potential health risks |
| 24 | | associated with chemicals commonly used in beauty |
| 25 | | products. |

| 1 | | (2) A list of specific ingredients commonly found in |
| 2 | | products such as hair relaxers, hair dyes, nail polishes, |
| 3 | | and other personal care items, along with their known or |
| 4 | | suspected health effects. |
| 5 | | (3) Contact information for the Illinois Department of |
| 6 | | Public Health and other trusted resources for additional |
| 7 | | information. |
| 8 | | (c) The Department of Public Health shall develop a |
| 9 | | pamphlet that complies with this Section and make that |
| 10 | | pamphlet available for download as a printable document on its |
| 11 | | Internet website. |
| 12 | | Section 20. Compliance and enforcement. |
| 13 | | (a) The Illinois Department of Public Health shall be |
| 14 | | responsible for monitoring compliance with this Act. The |
| 15 | | Department may inspect beauty supply retailers, barbershops, |
| 16 | | and salons to ensure that health risk information is properly |
| 17 | | posted and pamphlets are distributed in accordance with this |
| 18 | | Act. |
| 19 | | (b) A cosmetologist, barber, or beauty supply retailer |
| 20 | | found to be in violation of the provisions of this Act is |
| 21 | | guilty of a petty offense. |
| 22 | | (c) The requirements of this Act do not apply to |
| 23 | | individuals or businesses who do not sell or use chemical |
| 24 | | products in the course of their operation. |
