2025 and 2026 HB3241 Introduced 2/18/2025, by Rep. Michael J. Coffey, Jr. SYNOPSIS AS INTRODUCED: | | | Amends the Illinois TRUST Act. Provides that, notwithstanding any other provision of law to the contrary, a county is not required to comply with the provisions of the Act if the county board of the county adopts a resolution for that purpose on or after the effective date of the amendatory Act. Provides that if the county board adopts such a resolution, neither the county nor any officer or employee of the county shall be civilly or criminally liable for noncompliance with the Act. |

| 1 | | AN ACT concerning government. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Illinois TRUST Act is amended by adding |
| 5 | | Section 35 as follows: |
| 6 | | (5 ILCS 805/35 new) |
| 7 | | Sec. 35. County board resolution; opt out. Notwithstanding |
| 8 | | any other provision of law to the contrary, a county is not |
| 9 | | required to comply with the provisions of this Act if the |
| 10 | | county board of the county adopts a resolution for that |
| 11 | | purpose on or after the effective date of this amendatory Act |
| 12 | | of the 104th General Assembly. If the county board adopts such |
| 13 | | a resolution, neither the county nor any officer or employee |
| 14 | | of the county shall be civilly or criminally liable for |
| 15 | | noncompliance with this Act. |
