AMENDMENT TO HOUSE BILL 3275

AMENDMENT NO. ______. Amend House Bill 3275 by replacing everything after the enacting clause with the following:

"Section 5. The Interscholastic Athletic Organization Act is amended by adding Section 1.12 as follows:

(105 ILCS 25/1.12 new)

Sec. 1.12. Mandatory training in CPR, first aid, and use of an AED. An association or other entity that has as one of its purposes promoting, sponsoring, regulating, or in any manner providing for interscholastic athletics or any form of athletic competition among schools and students within this State shall require all paid school head coaches or chief sponsors of an activity to obtain training in cardiopulmonary resuscitation (CPR), first aid, and the use of an automated external defibrillator (AED). Training in CPR and AED use shall be consistent with national, evidence-based, emergency cardiovascular care guidelines and shall be completed every 2 years.

Section 10. The School Safety Drill Act is amended by changing Section 60 as follows:

Sec. 60. Cardiac emergency response plan.

(a) A school district and a private school shall develop a cardiac emergency response plan, in place in accordance with guidelines set forth by either (i) the American Heart Association or Project ADAM or (ii) other nationally recognized, evidence-based standards, that addresses the appropriate response to incidents involving an individual experiencing sudden cardiac arrest or a similar life-threatening emergency while at a school or at a school-sponsored activity or event. The plan must be distributed to all teachers, administrators, school support personnel, coaches, and other school staff identified by school administrators at each school.

(b) A cardiac emergency response plan shall include, but is not limited to, the following:

(1) Procedures to follow in the event of a cardiac emergency while on school premises at a school.

(2) A listing of every automated external defibrillator (AED) that is present. Each AED shall be and clearly marked, maintained as recommended by the manufacturer, and or easily accessible at school athletic venues and events and at school and the maintenance schedule for the automated external defibrillator. The AEDs automated external defibrillators shall be installed in accordance with the Physical Fitness Facility Medical Emergency Preparedness Act, guidelines from the American Heart Association, or other nationally recognized guidelines focused on emergency cardiovascular care.

(3) Education on the symptoms and warning signs of sudden cardiac arrest, Information on hands-only cardiopulmonary resuscitation, and the use of AEDs for automated external defibrillators to teachers, administrators, coaches, assistant coaches, and other school staff identified by school administrators, in accordance with Section 22-115 of the School Code.

(c) Individuals shall be identified by a school district to serve on a cardiac emergency response plan team. Those individuals shall be trained in cardiopulmonary resuscitation and the use of an AED consistent with national, evidence-based, emergency cardiovascular care guidelines.

The cardiac emergency response plan team shall conduct an annual cardiac response drill to practice the steps established in the cardiac emergency response plan, which may be in partnership with local emergency medical services. Cardiac response drills may be conducted without student participation.

(d) A school district and its school board and each member of the school board, a private school and its governing body and each member of the governing body, an administrator, principal, teacher, or school employee, and any member of a school district's or private school's safety or crisis response team, whether the member is a student or an adult, are immune from any liability incurred through or caused by an act or omission related to the requirements of this Section, including any act or omission while carrying out any of the elements of a cardiac emergency response plan, as developed or implemented in accordance with this Section, or as a result of a failure to carry out any of the elements of the cardiac emergency response plan, unless the act or omission was willful or wanton.

Section 99. Effective date. This Act takes effect July 1, 2027.".
