SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Honorable Funerals for First Responders Act. Provides that a first responder killed in the line of duty shall receive an honorable funeral. Defines "honorable funeral" as a funeral that respects the wishes of the deceased first responder and the family of the deceased first responder and includes religious observances desired by the deceased first responder and the family of the deceased first responder. Provides that an elected official may not attend the funeral of a first responder killed in the line of duty if the elected official knows, or has reason to know, that the family of the first responder killed in the line of duty does not wish the elected official to attend the funeral. Provides that in no case shall any elected official be required to attend the funeral of a first responder killed in the line of duty. Provides that the family of the first responder killed in the line of duty shall have sole discretion over which elected official may attend the funeral of a first responder killed in the line of duty. Provides that, before an elected official attends the funeral of a first responder killed in the line of duty, the elected official must make reasonable efforts to learn if the family of the first responder killed in the line of duty would like the elected official to attend the funeral. Defines other terms.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Honorable Funerals for First Responders Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Elected official" includes any person appointed or
8elected to any office in the State or a unit of local
9government.
10    "First responder" includes:
11        (1) a law enforcement officer as defined in Section 2
12    of the Line of Duty Compensation Act;
13        (2) a fireman as defined in Section 2 of the Line of
14    Duty Compensation Act; and
15        (3) emergency medical service personnel as defined in
16    Emergency the Medical Services (EMS) Systems Act.
17    "Honorable funeral" means a funeral that respects the
18wishes of the deceased first responder and the family of the
19deceased first responder and includes religious observances
20desired by the deceased first responder and the family of the
21deceased first responder.
 
22    Section 10. Honorable funeral services. Notwithstanding

1any other provision of law, a first responder killed in the
2line of duty shall receive an honorable funeral.
 
3    Section 15. Elected officials. An elected official may not
4attend the funeral of a first responder killed in the line of
5duty if the elected official knows, or has reason to know, that
6the family of the first responder killed in the line of duty
7does not wish the elected official to attend the funeral. In no
8case shall any elected official be required to attend the
9funeral of a first responder killed in the line of duty. The
10family of the first responder killed in the line of duty shall
11have sole discretion over which elected official may attend
12the funeral of a first responder killed in the line of duty.
