AMENDMENT TO HOUSE BILL 3385

2    AMENDMENT NO. ______. Amend House Bill 3385 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Mental Health Early Action on Campus Act
5is amended by changing Sections 30 and 40 as follows:
 
6    (110 ILCS 58/30)
7    Sec. 30. Training.
8    (a) The board of trustees of each public college or
9university must designate an expert panel to develop and
10implement policies and procedures that (i) advise students,
11faculty, and staff on the proper procedures for identifying
12and addressing the needs of students exhibiting symptoms of
13mental health conditions, (ii) promote understanding of the
14rules of Section 504 of the federal Rehabilitation Act of 1973
15and the federal Americans with Disabilities Act of 1990 to
16increase knowledge and understanding of student protections

1under the law, and (iii) provide training if appropriate.
2    The expert panel shall be comprised of at least 2
3administrators, 2 members of faculty, and one mental health
4professional.
5    (b) The Technical Assistance Center under Section 45 shall
6set initial standards for policies and procedures referenced
7in subsection (a) to ensure statewide consistency.
8    (c) All resident assistants in a student housing facility,
9advisors, and campus security of a public college or
10university must participate in a national Mental Health First
11Aid training course or a similar program prior to the
12commencement of their duties. Training must include the
13policies and procedures developed by the public college or
14university referenced under subsection (a).

17    Sec. 40. Local partnerships.
18    (a) Each public college or university must form strategic
19partnerships with local mental health service providers to
20improve overall campus mental wellness and augment on-campus
21capacity. The strategic partnerships must include linkage
22agreements with off-campus mental health service providers
23that establish a foundation for referrals for students when
24needs cannot be met on campus due to capacity or preference of
25the student. The strategic partnerships must also include (i)

1avenues for on-campus and off-campus mental health service
2providers to increase visibility to students via marketing and
3outreach, (ii) opportunities to engage the student body
4through student outreach initiatives like mindfulness
5workshops or campus-wide wellness fairs, and (iii)
6opportunities to support awareness and training requirements
7under this Act.
8    (b) Through a combination of on-campus capacity,
9off-campus linkage agreements with mental health service
10providers, and contracted telehealth therapy services, each
11public college or university shall attempt to meet a benchmark
12ratio of one clinical, non-student staff member to 1,250
13students. However, each public college or university shall
14provide at least 3 licensed mental health professionals or
15less than 3 if the benchmark ratio falls under 3. The mental
16health professionals must be employed by the public college or
17university. Service hours for the mental health professionals
18should be informed by campus utilization data and may include
19in-person and telehealth modalities to ensure access to the
20mental health professionals. If linkage agreements are used,
21the agreements must include the capacity of students providers
22are expected to serve within the agency. Two years after the
23effective date of this Act, and once every 5 years thereafter,
24the Technical Assistance Center developed under Section 45
25must propose to the General Assembly an updated ratio based on
26actual ratios in this State and any new information related to

1appropriate benchmarks for clinician-to-student ratios. The
2updated benchmark must represent a ratio of no less than one
3clinical, non-student staff member to 1,250 students.
4    (c) Each public college or university must work with local
5resources, such as on-campus mental health counseling centers
6or wellness centers, local mental health service providers, or
7non-providers, such as affiliates of the National Alliance on
8Mental Illness, and any other resources to meet the awareness
9and training requirements under Sections 25 and 30 of this
10Act.
