SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Emergency Digital Communication Pilot Permits Act. Allows the Department of Transportation to issue pilot permits for digital public safety communication devices on State highway rights-of-way. Provides that digital public safety communication devices shall be operated solely by a unit of local government, shall not display commercial advertising, and must be installed on municipally owned infrastructure with emergency override functionality. Requires the Department to adopt rules to implement the Act. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Emergency Digital Communication Pilot Permits Act.
 
6    Section 5. Purpose. The purpose of this Act is to
7authorize municipalities in this State to install and operate
8noncommercial digital banner systems within State highway
9rights-of-way for the purpose of enhancing homeland security,
10emergency preparedness, and public safety communications.
 
11    Section 10. Definition. As used in this Act, "digital
12public safety communication device" means a digital or LED
13display installed by or on behalf of a local governmental
14entity, used exclusively for emergency alerts, public safety
15messaging, and civic announcements.
 
16    Section 15. Permitting. Notwithstanding any provision in
17Section 6.02 of the Highway Advertising Control Act of 1971 or
18Section 9-112.2 of the Illinois Highway Code to the contrary,
19the Department of Transportation may issue pilot permits for
20digital public safety communication devices on State highway
21rights-of-way, subject to regulatory guidelines developed by

1the Department of Transportation.
 
2    Section 20. Restrictions. Digital public safety
3communication devices shall be operated solely by a unit of
4local government, shall not display commercial advertising,
5and must be installed on municipally owned infrastructure with
6emergency override functionality.
 
7    Section 25. Rulemaking. The Department of Transportation
8shall adopt rules for implementation of this Act, including
9eligibility, content restrictions, monitoring, and enforcement
10mechanisms.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
