SYNOPSIS AS INTRODUCED:

720 ILCS 5/33-10 new

    Amends the Criminal Code of 2012. Provides that a law enforcement officer shall not wear any mask or neck gaiter while interacting with the public in the performance of the officer's duties, except for medical grade masks that are surgical or N95 respirators designed to prevent the transmission of airborne diseases and diseases, masks designed to protect against exposure to smoke during a state of emergency related to wildfires, or protective gear used by Special Weapons and Tactics (SWAT) team officers necessary to protect their faces from harm while they perform their SWAT responsibilities. Provides that "mask" does not include a face shield if it does not conceal the wearer's face and does not include a clear mask that does not conceal the wearer's face. Provides that while executing law enforcement duties, a law enforcement officer shall display on the uniform that the officer wears: (i) the officer's name or badge number and (ii) the agency in which the officer is employed. Provides that the provisions do not apply to an officer while the officer is engaged in an undercover assignment. Provides that moneys from fines received for convictions under this provision shall be deposited into a special fund in the State treasury to be known as the Immigrant Family Services Fund and shall be used by the Department of Human Services to provide immigrant family services as determined by the Secretary of Human Services. Establishes penalties for violations. Defines terms. Amends the State Finance Act to make conforming changes.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.1030 as follows:
 
6    (30 ILCS 105/5.1030 new)
7    Sec. 5.1030. The Immigrant Family Services Fund.
 
8    Section 10. The Criminal Code of 2012 is amended by adding
9Section 33-10 as follows:
 
10    (720 ILCS 5/33-10 new)
11    Sec. 33-10. Law enforcement; use of masks.
12    (a) In this Section:
13    "Law enforcement officer" means any officer of a local,
14State, or federal law enforcement agency, or any person acting
15on behalf of a local, State, or federal law enforcement
16agency. A person acts on behalf of a local, State, or federal
17law enforcement agency when the person is summoned or directed
18by a law enforcement officer of a local, State, or federal law
19enforcement agency to assist the law enforcement officer in
20the execution of the officer's duties.

3    (b) A law enforcement officer shall not wear any mask or

13    (c) While executing law enforcement duties, a law

17    (d) This Section does not apply to an officer while the
18officer is engaged in an undercover assignment.
19    (e)(1) A violation of this Section by any person acting on
20behalf of a local, State, or federal law enforcement agency,
21who is not a sworn peace officer or agent, is a Class A
22misdemeanor.
23    (2) A violation of this Section by a sworn peace officer of
24a local, State, or federal law enforcement agency, or an agent
25of a State, local, or federal law enforcement agency, is a
26petty offense. A second or subsequent violation is a Class A

1misdemeanor.
2    (3) A violation of both subsections (b) and (c) committed
3during a single act only constitutes one violation of this
4Section.
5    (4) Moneys from fines received for convictions under this
6Section shall be deposited into a special fund in the State

8shall be used by the Department of Human Services to provide
9immigrant family services as determined by the Secretary of
10Human Services.
