|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Counties Code is amended by adding Section |
| 5 | | 5-12024 as follows:
|
| 6 | | (55 ILCS 5/5-12024 new) |
| 7 | | Sec. 5-12024. Solar energy systems. |
| 8 | | (a) For the purposes of this Section, "solar energy |
| 9 | | system" has the meaning given to that term in the Homeowners' |
| 10 | | Energy Policy Statement Act. |
| 11 | | (b) Notwithstanding any provision of this Code or other |
| 12 | | provision of law, a county may not adopt any ordinance or |
| 13 | | resolution or exercise any power that prohibits or has the |
| 14 | | effect of prohibiting the installation of a solar energy |
| 15 | | system. |
| 16 | | (c) A home rule unit may not regulate a solar energy system |
| 17 | | in a manner inconsistent with this Section. This Section is a |
| 18 | | limitation under subsection (i) of Section 6 of Article VII of |
| 19 | | the Illinois Constitution on the concurrent exercise by home |
| 20 | | rule units of powers and functions exercised by the State.
