SYNOPSIS AS INTRODUCED:
 
70 ILCS 1205/2-25  from Ch. 105, par. 2-25

    Amends the Park District Code. Provides that, when the office of a member of the governing board of a park district may be declared vacant, the office is not vacant until the office is declared vacant at a meeting of the members of the board. Provides that the amendatory changes are declaratory of existing law.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Code is amended by changing
5Section 2-25 as follows:
 
6    (70 ILCS 1205/2-25)  (from Ch. 105, par. 2-25)
7    Sec. 2-25. Vacancies. Whenever any member of the governing
8board of any park district (i) dies, (ii) resigns, (iii)
9becomes under legal disability, (iv) ceases to be a legal
10voter in the district, (v) is convicted in any court located in
11the United States of any infamous crime, bribery, perjury, or
12other felony, (vi) refuses or neglects to take his or her oath
13of office, (vii) neglects to perform the duties of his or her
14office or attend meetings of the board for the length of time
15as the board fixes by ordinance, or (viii) for any other reason
16specified by law, that office may be declared vacant. However,
17the office is not vacant until the office is declared vacant at
18a meeting of the members of the board. Vacancies shall be
19filled by appointment by a majority of the remaining members
20of the board. Any person so appointed shall hold his or her
21office until the next regular election for this office, at
22which a member shall be elected to fill the vacancy for the
23unexpired term, subject to the following conditions:

1        (1) If the vacancy occurs with less than 28 months
2    remaining in the term, the person appointed to fill the
3    vacancy shall hold his or her office until the expiration
4    of the term for which he or she has been appointed, and no
5    election to fill the vacancy shall be held.
6        (2) If the vacancy occurs with more than 28 months
7    left in the term, but less than 151 days before the next
8    regularly scheduled election for this office, the person
9    appointed to fill the vacancy shall hold his or her office
10    until the second regularly scheduled election for the
11    office following the appointment, at which a member shall
12    be elected to fill the vacancy for the unexpired term.
13    The changes made by this amendatory Act of the 104th
14General Assembly are declaratory of existing law.
