AMENDMENT TO HOUSE BILL 4279

2    AMENDMENT NO. ______. Amend House Bill 4279, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 4, immediately below line 8, by inserting the
5following:
6        "(9.5) The General Assembly further recognizes that
7    implementation of expanded passenger rail service on
8    corridors that utilize privately owned railroad
9    infrastructure will require negotiated agreements and
10    operational cooperation with the applicable railroad
11    infrastructure owners. The State's aspirational frequency
12    goals are intended to guide planning and investment
13    decisions and do not supersede the need for mutually
14    agreed operational arrangements."; and
 
15on page 6, line 19, after "135.", by inserting "Prior to
16advancing a corridor toward implementation, the Department of
17Transportation shall evaluate operational feasibility, host

1railroad capacity, infrastructure requirements, and market
2demand consistent with applicable federal Service Development
3Plan guidance where applicable."; and
 
4on page 7, line 5, after "schedules.", by inserting "Such
5agreements may include cost-sharing arrangements, capital
6partnerships, or other jointly beneficial infrastructure
7investments intended to increase network capacity, improve
8reliability, and support both passenger and freight
9transportation."; and
 
10on page 7, by replacing lines 24 through 26 with the following:
11        "(4) coordination with neighboring states, Amtrak, and
12    federal agencies to advance these targets; and
13        (5) an analysis of projected ridership demand, market
14    potential, and travel behavior for each corridor,
15    including surveys or other demand validation tools as
16    appropriate, to inform service development planning and
17    investment prioritization."; and
 
18on page 9, immediately below line 7, by inserting the
19following:
20    "(k) In carrying out passenger rail planning and
21implementation under this Act, the Department of
22Transportation shall consult with and seek the cooperation of
23host railroads and rail infrastructure owners whose facilities

1may be affected by proposed passenger rail service and shall
2pursue collaborative solutions intended to support both
3passenger and freight mobility.
4    (l) Nothing in this Act shall be construed to authorize
5passenger rail service over privately owned rail
6infrastructure absent an agreement with the applicable
7infrastructure owner, except where the State or a public
8entity acquires such infrastructure or constructs new rail
9facilities consistent with applicable law.".
