SYNOPSIS AS INTRODUCED:
 
410 ILCS 35/16

    Amends the Equitable Restrooms Act. Provides that the owner or operator of each State-owned building and the owner or operator of each public building (rather than only the owner or operator of each State-owned building) shall (1) ensure that one or more of the public restrooms is designated as an adult changing station, with certain requirements, (2) maintain, repair, and replace each adult changing table as necessary, (3) clean each adult changing station with the same frequency as the other public restrooms, and (4) provide sufficient floor space to comply with the Americans with Disabilities Act. Provides that the owner or operator of each State-owned building and the owner or operator of each public building (rather than only the owner or operator of each State-owned building) shall ensure that the entrance to each restroom has conspicuous signage and that the central directory for the building, if it exists, indicates the location. Provides that any public building or State-owned building that is constructed on or after January 1, 2029, and any public building or State-owned building with an estimated renovation cost of at least $10,000 that requires the issuance of a building permit for the renovation and that is renovated on or after January 1, 2031, must contain and provide access to not less than one powered, height adjustable, adult changing table, installed per the manufacturer's recommendations, in a single occupancy restroom that is universal to gender and available to the public. 1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Equitable Restrooms Act is amended by
5changing Section 16 as follows:
 
6    (410 ILCS 35/16)
7    Sec. 16. Adult changing station.
8    (a) In this Section:
9    "Adult changing station" means a private, enclosed family
10or assisted-use toilet facility that:
11        (1) contains containing an adult changing table that
12    is capable of serving persons of any age;
13        (2) is accessible to the persons using the changing
14    stations and a care provider; and
15        (3) is equipped with all of the following:
16            (A) a waste receptacle;
17            (B) a toilet and a sink;
18            (C) a coat hook located in close proximity to the
19        changing surface;
20            (D) a soap dispenser;
21            (E) a paper towel dispenser;
22            (F) signage indicating "adult changing station" at
23        the entrance to the room;

1            (G) signage within the room indicating the weight
2        capacity and instructions for operation of the adult
3        changing table;
4            (H) a side and end maneuvering clearance of at
5        least 36 inches.
6    "Adult changing table" means a powered, height-adjustable
7table that:
8        (1) has, at a minimum, the following safety features:
9            (A) safety rails on each side that (i) shall be a
10        minimum of two-thirds of the length of the changing
11        surface, (ii) shall be centered, plus or minus 3
12        inches, along the long open sides of the changing
13        surface, and (iii) shall be capable of being raised or
14        lowered; and
15            (B) a safety belt;
16        (2) is capable of being lowered to a height of 17 19
17    inches or less and raised to a height of at least 38
18    inches;
19        (3) is at least 30 25 inches wide and at least 70 72
20    inches long; and
21        (4) supports at least 400 pounds.
22    "Public building" means:
23        (1) any establishment with the capacity to serve 1,500
24    or more persons per day;
25        (2) a building or structure used for exhibition or
26    entertainment, including, but not limited to, a movie

1    theater, performance theater, concert hall, convention
2    center, sports arena or stadium, shopping mall, shopping
3    center, or a store that is larger than 40,000 square feet;
4        (3) a building or structure used for public display or
5    collection, including, but not limited to, a museum,
6    library, or gallery;
7        (4) a building or structure that is located in a place
8    of recreation, including, but not limited to, a park, zoo,
9    or amusement park; or
10        (5) any of the following located in this State: (i) an
11    airport terminal; (ii) a bus station; (iii) a place of
12    education; (iv) a hospital; (v) a hospital related
13    outpatient clinic; or (vi) a rehabilitation facility.
14    "State-owned building" means the State Capitol Building, a
15State park campground with plumbing and electricity at toilet
16locations, a State park visitor center with plumbing and
17electricity at toilet locations, or a rest stop located on an
18interstate highway.
19    (b) The owner or operator of each State-owned building and
20the owner or operator of each public building shall do all of
21the following: install and maintain in that building at least
22one adult changing station that is accessible when the
23building is open to the public
24        (1) ensure that one or more of the public restrooms is
25    designated as an adult changing station and has a powered,
26    height-adjustable, adult-size changing table that is

1    capable of serving persons of any age;
2        (2) maintain, repair, and replace each adult changing
3    table as necessary to ensure safety and ease of use;
4        (3) clean each adult changing station with the same
5    frequency as the other public restrooms located within the
6    facility; and
7        (4) provide sufficient floor space in installation of
8    the adult changing tables to comply with the requirements
9    of the Americans with Disabilities Act standards for
10    accessible design, as prescribed in 28 CFR 35.151 and 36
11    CFR Part 1191, Appendices B and D.
12    (c) The owner or operator of each State-owned building and
13the owner or operator of each public building shall ensure
14that:
15        (1) the entrance to each restroom in the building has
16    conspicuous signage indicating the location of the adult
17    changing stations in the building; and
18        (2) the central directory for the building, if such a
19    directory exists, indicates the location of the adult
20    changing stations in the building.
21    (d) Any public building or State-owned building that is
22constructed on or after January 1, 2029, and any public
23building or State-owned building with an estimated renovation
24cost of at least $10,000 that requires the issuance of a
