1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Equitable Restrooms Act is amended by
5changing Section 16 as follows:
 
6    (410 ILCS 35/16)
7    Sec. 16. Adult changing station.
8    (a) In this Section:
9    "Adult changing station" means a wheelchair accessible
10toilet facility compliant with the federal Americans with
11Disabilities Act of 1990 and regulations adopted under that
12Act or a private, enclosed family or assisted-use toilet
13facility, both of which shall meet all of the following
14requirements:
15        (1) the facility contains containing an adult changing
16    table that is capable of serving persons of any age;
17        (2) the facility is accessible under the federal
18    Americans with Disabilities Act of 1990 and regulations
19    adopted thereunder; and
20        (3) the facility is equipped with all of the
21    following:
22            (A) a waste receptacle;
23            (B) a toilet and a sink;

1            (C) a coat hook located in close proximity to the
2        changing surface;
3            (D) a soap dispenser;
4            (E) a paper towel dispenser;
5            (F) signage indicating "adult changing station" at
6        the entrance to the room;
7            (G) signage within the room indicating the weight
8        capacity and instructions for operation of the adult
9        changing table; and
10            (H) a side and end maneuvering clearance of at
11        least 36 inches.
12    "Adult changing table" means a powered, height-adjustable
13table that:
14        (1) has, at a minimum, the following safety features:
15            (A) safety rails on each side that (i) are a
16        minimum of two-thirds of the length of the changing
17        surface, (ii) are centered, plus or minus 3 inches,
18        along the long open sides of the changing surface, and
19        (iii) are capable of being raised or lowered; and
20            (B) a safety belt;
21        (2) is capable of being lowered to a height of 17 19
22    inches or less and raised to a height of at least 38
23    inches;
24        (3) is at least 30 25 inches wide and at least 70 72
25    inches long; and
26        (4) supports at least 400 pounds.

1    "Public building" means a building or establishment
2constructed on or after January 1, 2029 that is:
3        (1) any establishment with the capacity to serve 1,500
4    or more persons per day that is not a place of education;
5        (2) a building or structure used for exhibition or
6    entertainment, including, but not limited to, a movie
7    theater, performance theater, concert hall, convention
8    center, sports arena or stadium, shopping mall, shopping
9    center, or a store that is larger than 40,000 square feet;
10        (3) a building or structure used for public display or
11    collection, including, but not limited to, a museum,
12    library, or gallery;
13        (4) one building or structure that is located in a
14    place of recreation, including, but not limited to, a
15    park, zoo, or amusement park; the owner or operator of
16    that place of recreation or the owner's or operator's
17    agent may designate the building or structure that is
18    located in that place of recreation as the public building
19    under this Act; or
20        (5) any of the following located in this State: (i) an
21    airport terminal; (ii) a bus station; (iii) a place of
22    education, not including an athletic stadium, that is
23    designed to educate 1,500 students or more; (iv) a
24    hospital; (v) a hospital related outpatient clinic; or
25    (vi) a rehabilitation facility.
26    "State-owned building" means the State Capitol Building, a

1State park campground with plumbing and electricity at toilet
2locations, a State park visitor center with plumbing and
3electricity at toilet locations, or a rest stop located on an
4interstate highway.
5    (b) The owner or operator of each State-owned building and
6the owner or operator of each public building built after
7January 1, 2029 shall do all of the following: install and
8maintain in that building at least one adult changing station
9that is accessible when the building is open to the public
10        (1) install a minimum of one adult changing station;
11        (2) maintain, repair, and replace each adult changing
12    table as necessary to ensure safety and ease of use;
13        (3) clean each adult changing station with the same
14    frequency as the other public restrooms located within the
15    facility; and
16        (4) provide sufficient floor space around the adult
17    changing table to comply with the requirements of the
18    Americans with Disabilities Act standards for accessible
19    design, as prescribed in 28 CFR 35.151 and 36 CFR Part
20    1191, Appendices B and D.
21    (c) The owner or operator of each State-owned building and
22the owner or operator of each public building shall ensure
23that:
24        (1) except for places of education, the entrance to
25    each restroom in the building has conspicuous signage
26    indicating the location of the adult changing stations in

1    the building, and, for places of education, only the
2    entrance to the restroom that contains an adult changing
3    station shall be required to have conspicuous signage
4    indicating the adult changing station; and
5        (2) the central directory for the building, if such a
6    directory exists, indicates the location of the adult
7    changing stations in the building.
