AMENDMENT TO HOUSE BILL 4379

2    AMENDMENT NO. ______. Amend House Bill 4379, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Equitable Restrooms Act is amended by
6changing Section 16 as follows:
 
7    (410 ILCS 35/16)
8    Sec. 16. Adult changing station.
9    (a) In this Section:
10    "Adult changing station" means a wheelchair accessible
11toilet facility compliant with the federal Americans with
12Disabilities Act of 1990 and regulations adopted under that
13Act or a private, enclosed family or assisted-use toilet
14facility, both of which shall meet all of the following
15requirements:
16        (1) the facility contains containing an adult changing

1    table that is capable of serving persons of any age;
2        (2) the facility is accessible under the federal
3    Americans with Disabilities Act of 1990 and regulations
4    adopted thereunder; and
5        (3) the facility is equipped with all of the
6    following:
7            (A) a waste receptacle;
8            (B) a toilet and a sink;
9            (C) a coat hook located in close proximity to the
10        changing surface;
11            (D) a soap dispenser;
12            (E) a paper towel dispenser;
13            (F) signage indicating "adult changing station" at
14        the entrance to the room;
15            (G) signage within the room indicating the weight
16        capacity and instructions for operation of the adult
17        changing table; and
18            (H) a side and end maneuvering clearance of at
19        least 36 inches.
20    "Adult changing table" means a powered, height-adjustable
21table that:
22        (1) has, at a minimum, the following safety features:
23            (A) safety rails on each side that (i) are a
24        minimum of two-thirds of the length of the changing
25        surface, (ii) are centered, plus or minus 3 inches,
26        along the long open sides of the changing surface, and

1        (iii) are capable of being raised or lowered; and
2            (B) a safety belt;
3        (2) is capable of being lowered to a height of 17 19
4    inches or less and raised to a height of at least 38
5    inches;
6        (3) is at least 30 25 inches wide and at least 70 72
7    inches long; and
8        (4) supports at least 400 pounds.
9    "Public building" means a building or establishment
10constructed on or after January 1, 2029 that is:
11        (1) any establishment with the capacity to serve 1,500
12    or more persons per day that is not a place of education;
13        (2) a building or structure used for exhibition or
14    entertainment, including, but not limited to, a movie
15    theater, performance theater, concert hall, convention
16    center, sports arena or stadium, shopping mall, shopping
17    center, or a store that is larger than 40,000 square feet;
18        (3) a building or structure used for public display or
19    collection, including, but not limited to, a museum,
20    library, or gallery;
21        (4) one building or structure that is located in a
22    place of recreation, including, but not limited to, a
23    park, zoo, or amusement park; the owner or operator of
24    that place of recreation or the owner's or operator's
25    agent may designate the building or structure that is
26    located in that place of recreation as the public building

1    under this Act; or
2        (5) any of the following located in this State: (i) an
3    airport terminal; (ii) a bus station; (iii) a place of
4    education, not including an athletic stadium, that is
5    designed to educate 1,500 students or more; (iv) a
6    hospital; (v) a hospital related outpatient clinic; or
7    (vi) a rehabilitation facility.
8    "State-owned building" means the State Capitol Building, a
9State park campground with plumbing and electricity at toilet
10locations, a State park visitor center with plumbing and
11electricity at toilet locations, or a rest stop located on an
12interstate highway.
13    (b) The owner or operator of each State-owned building and
14the owner or operator of each public building built after
15January 1, 2029 shall do all of the following: install and
16maintain in that building at least one adult changing station
17that is accessible when the building is open to the public
18        (1) install a minimum of one adult changing station;
19        (2) maintain, repair, and replace each adult changing
20    table as necessary to ensure safety and ease of use;
21        (3) clean each adult changing station with the same
22    frequency as the other public restrooms located within the
23    facility; and
24        (4) provide sufficient floor space around the adult
25    changing table to comply with the requirements of the
26    Americans with Disabilities Act standards for accessible

1    design, as prescribed in 28 CFR 35.151 and 36 CFR Part
2    1191, Appendices B and D.
3    (c) The owner or operator of each State-owned building and
4the owner or operator of each public building shall ensure
5that:
6        (1) except for places of education, the entrance to
7    each restroom in the building has conspicuous signage
8    indicating the location of the adult changing stations in
9    the building, and, for places of education, only the
10    entrance to the restroom that contains an adult changing
11    station shall be required to have conspicuous signage
12    indicating the adult changing station; and
13        (2) the central directory for the building, if such a
14    directory exists, indicates the location of the adult
15    changing stations in the building.
