1    AN ACT concerning courts.
 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly:
 
4    Section 5. The Pretrial Services Act is amended by 
5changing Section 25 and adding Section 25.1 as follows:
 
6    (725 ILCS 185/25)  (from Ch. 38, par. 325)
7    Sec. 25. (a) The pretrial services agency shall provide 
8written notification to supervised persons of court appearance 
9obligations, and may require supervised persons to 
10periodically report their periodic reporting by letter, 
11telephone, or in person personal appearance to verify such 
12compliance with court-ordered pretrial release conditions. The 
13pretrial services agency must provide written notification of 
14court appearance obligations to all persons under pretrial 
15services supervision or charged with a felony offense as 
16follows: .
17        (1) The pretrial services agency must provide at least 
18    2 text notices to the defendant before each court 
19    appearance with one notice the day before the required 
20    court appearance.
21        (2) The pretrial services agency must maintain a copy 
22    of the content of the message and a delivery receipt as 
23    part of its records.

1    (b) This Section does not apply if a pretrial services 
2agency does not have the information needed from a defendant 
3to send a text message notification to the defendant. The 
4pretrial services agency must take all reasonable actions to 
5get the information to send a text notification and to 
6coordinate with law enforcement and the courts in that effort.

9    Sec. 25.1. Feasibility study of text reminders. In 
10coordination with circuit clerks, the Office of Statewide 
11Pretrial Services must conduct a study of the feasibility of 
12sending automated text message reminders of court appearance 
13obligations to all persons charged with a criminal offense. 
14The Office of Statewide Pretrial Services must provide an 
15update on the feasibility study required by this Section no 
16later than December 31, 2026.
