AMENDMENT TO HOUSE BILL 4514

2    AMENDMENT NO. ______. Amend House Bill 4514 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Utilities Act is amended by adding
5Section 9-226.5 as follows:
 
6    (220 ILCS 5/9-226.5 new)
7    Sec. 9-226.5. General rate increase requests; public
8hearings.
9    (a) For any general rate increase requested by a gas,
10electric, water, or sewer public utility company under the
11provisions of this Act, and upon request from any ratepayer
12affected by the requested general rate increase or any group
13with members affected by the requested general rate increase,
14the Commission shall hold at least one in-person public
15hearing during which members of the public can provide input
16on the requested general rate increase.

1    (b) Any ratepayer affected by a requested general rate
2increase or group with members affected by a requested general
3rate increase may testify at the public hearing and may file
4statements regarding the subject matter of the public hearing
5with the person or persons conducting the public hearing. The
6Commission shall give each member of the public a reasonable
7amount of time to testify and be heard by the Commission at the
8public hearing. Any person requesting to speak at the public
9hearing shall be heard prior to the end of the public hearing.
10    (c) A public hearing under this Section shall be held in
11the service territory of the gas, electric, water, or sewer
12public utility company that requested the general rate
13increase at a time and location to be determined by the
14Commission. In determining the location of the public hearing,
15the Commission shall comply with the following requirements:
16        (1) The public hearing shall be located in a city that
17    is within the service territory of the gas, electric,
18    water, or sewer public utility company and that has a high
19    population density for that service territory.
20        (2) The Commission shall consider the ability of
21    members of the public to attend the public hearing and the
22    ease of access, including the availability of public
23    transit, to the area where the public hearing will be
24    held.
25    (d) The Commission shall provide reasonable notice to
26ratepayers affected by a requested general rate increase and

1any groups with members affected by a requested general rate
2increase regarding a public hearing under this Section. For
3the purposes of this subsection (d), "reasonable notice" means
4notice that is provided at least 30 calendar days before a
5public hearing and that is given to the public and to each
6customer of the applicable gas, electric, water, or sewer
7public utility company.
8    (e) The gas, electric, water, or sewer public utility
9company shall provide notice of a ratepayer's right to request
10a public hearing, including a description of the ratepayer's
11right, to all customers potentially affected by a requested
12general rate increase in the first bill that is sent to each
13applicable customer after the filing of the requested general
14rate increase. The notice shall include clear instructions on
15how to request a public hearing, including, but not limited
16to, the Commission's phone number, the Commission's mailing
17address, and a link to the website where an electronic request
18may be submitted, along with the applicable docket number of
19the filing. The Commission shall also provide a designated
20space where the public may submit a request for a public
21hearing on each docket's webpage.".
