AMENDMENT TO HOUSE BILL 4538

2    AMENDMENT NO. ______. Amend House Bill 4538 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Identity Verification for Consumer Services Act.
 
6    Section 5. Purpose. The purpose of this Act is to protect
7Illinois residents from identity theft by establishing
8mandatory identity verification standards before allowing the
9issuance of services that involve personal identifying
10information, including credit services, telecommunications,
11utilities, online platforms, healthcare access, and government
12benefit systems.
 
13    Section 10. Definitions. As used in this Act:
14    "Covered service" means any utility, telecommunications,
15credit account, online financial account, government benefit,

1or other service that uses personal identifying information to
2authorize access or extend service. "Covered service" includes
3any service that involves a high-risk transaction. "Covered
4service" does not include any public utility as defined in
5Section 3-105 of the Public Utilities Act, alternative retail
6electric supplier as defined in Section 16-102 of the Public
7Utilities Act, or alternative gas supplier as defined in
8Section 19-105 of the Public Utilities Act.
9    "High-risk transaction" means any transaction involving
10the transfer of funds, issuance of credit, remote access to
11financial records, or any financial service activation that
12may expose personal identifying information.
13    "Identity theft" means the unauthorized acquisition and
14use of personal identifying information to fraudulently obtain
15credit, benefits, or services.
16    "Identity verification" means the process of verifying a
17person's identity using 2 of the following forms of
18authentication:
19        (1) valid, government-issued photo identification;
20        (2) proof of address, such as a recent utility bill,
21    bank statement, or rental lease;
22        (3) biometric data, such as a fingerprint or facial
23    scan;
24        (4) secure digital verification through multi-factor
25    authentication; or
26        (5) knowledge-based authentication.

1    "Personal identifying information" includes, but is not
2limited to, full name, date of birth, social security number,
3driver's license or State identification card number, passport
4number, biometric identifiers, physical address, email
5address, telephone number, financial account numbers,
6insurance policy numbers, and medical or health-related
7information.
 
8    Section 15. Identity verification requirements. An entity
9that engages in a high-risk transaction involving a covered
10service shall use identity verification to verify a person's
11identity before initiating or modifying an agreement to
12provide the covered service.
 
13    Section 20. Recordkeeping. An entity that provides a
14covered service shall securely retain a record of the
15documentation collected under the identity verification
16process required under Section 15 for 3 years after the
17identity verification or as long as needed for identity
18verification purposes.
 
19    Section 25. Exemptions. The following are exempt from the
20requirements of this Act:
21        (1) services exclusively performed using in-person
22    physical identification checks;
23        (2) services for individuals under the age of 13 with

1    verified parental consent, as required under State and
2    federal law; and
3        (3) entities that are already subject to more
4    stringent federal identity verification regulations.
 
5    Section 30. Enforcement. A violation of this Act
6constitutes an unlawful practice under the Consumer Fraud and
7Deceptive Business Practices Act. All remedies, penalties, and
8authority granted to the Attorney General by the Consumer
9Fraud and Deceptive Business Practices Act shall be available
10to the Attorney General for the enforcement of this Act.
 
11    Section 35. Whistleblower protections. Any employee or
12agent of an entity that provides a covered service in this
13State who reports in good faith the entity's noncompliance
14with this Act shall be protected under the Whistleblower Act.
 
15    Section 40. Home rule. A home rule unit may not regulate
16identity verification in a manner inconsistent with the
17regulation by the State of identity verification under this
18Act. This Section is a limitation under subsection (i) of
19Section 6 of Article VII of the Illinois Constitution on the
20concurrent exercise by home rule units of powers and functions
21exercised by the State.
 
22    Section 90. The Consumer Fraud and Deceptive Business

1Practices Act is amended by adding Section 2MMMM as follows:
 
2    (815 ILCS 505/2MMMM new)
3    Sec. 2MMMM. Violations of the Identity Verification for
4Consumer Services Act. Any person who violates the Identity
5Verification for Consumer Services Act commits an unlawful
6practice within the meaning of this Act.
 
7    Section 99. Effective date. This Act takes effect January
81, 2027.".
