| Amends the Community Mental Health Act. In provisions permitting the removal of a community mental health board member, provides that prior to removal, the member must have an opportunity to be heard by the full membership of the governing body. Provides that after given notice and an opportunity to be heard, the member may be removed upon a 2/3 majority vote of the entire governing body of the appointing authority at a public meeting. |

| 1 | | AN ACT concerning mental health. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Community Mental Health Act is amended by |
| 5 | | changing Section 3c as follows: |
| 6 | | (405 ILCS 20/3c) (from Ch. 91 1/2, par. 303c) |
| 7 | | Sec. 3c. Any member of the community mental health board |
| 8 | | may be removed by the appointing officer for absenteeism, |
| 9 | | neglect of duty, misconduct or malfeasance in office, after |
| 10 | | being given a written statement of the charges and an |
| 11 | | opportunity to be heard thereon by the full membership of the |
| 12 | | governing body. After given notice and an opportunity to be |
| 13 | | heard, the member may be removed upon a 2/3 majority vote of |
| 14 | | the entire governing body of the appointing authority at a |
| 15 | | public meeting. |
