AMENDMENT TO HOUSE BILL 4730

2    AMENDMENT NO. ______. Amend House Bill 4730 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.13f as follows:
 
6    (305 ILCS 5/12-4.13f new)
7    Sec. 12-4.13f. Families Receiving Emergency Support for
8Hunger (FRESH) Program.
9    (a) Definitions. As used in this Section, "SNAP benefits"
10refers to both SNAP benefits provided under Chapter 51 of
11Title 7 of the United States Code, and SNAP benefits provided
12under Article XVI of this Code.
13    (b) Eligibility. Subject to available funding, the
14Department of Human Services shall establish a Families
15Receiving Emergency Support for Hunger (FRESH) Program to
16provide FRESH benefits to individuals subject to termination

1of their SNAP benefits, or a reduction in their household's
2monthly SNAP benefit allotment, if the termination or
3reduction in SNAP benefits occurred as a result of the
4individual failing to meet federal SNAP work requirements.
5    (c) Payment amount. Individuals eligible for FRESH
6benefits shall be provided a one-time lump sum payment equal
7to $600. Multiple individuals within the same SNAP household
8may receive FRESH benefits as set forth in subsection (e).
9    (d) Issuance.
10        (1) The Department of Human Services shall issue FRESH
11    benefits to eligible individuals automatically. The
12    Department shall not require any application, action, or
13    additional information from eligible individuals to
14    receive FRESH benefits.
15        (2) Where the reduction or termination of SNAP
16    benefits as set forth in subsection (b) occurred on or
17    after May 1, 2026, but prior to the first of the month
18    following the effective date of this amendatory Act of the
19    104th General Assembly, the Department shall provide FRESH
20    benefits within 10 calendar days.
21        (3) Where the reduction or termination of SNAP
22    benefits as set forth in subsection (b) occurred on or
23    after the first of the month following the effective date
24    of this amendatory Act of the 104th General Assembly, the
25    Department shall immediately issue FRESH benefits upon the
26    effective date of the termination or reduction of SNAP

1    benefits as set forth in subsection (b).
2    (e) Individuals eligible for FRESH benefits shall be
3limited to one issuance of FRESH benefits per individual
4subject to a reduction or termination of SNAP benefits as set
5forth in subsection (b). Multiple individuals within the same
6SNAP household may receive FRESH benefits.
7    (f) FRESH benefits under this Section shall be provided to
8eligible individuals in the form of cash benefits distributed
9via disbursement to an Electronic Benefit Transfer card.
10    (g) Data reporting. The Department shall publish monthly
11data on the number of individuals who have received FRESH
12benefits and the amount of FRESH benefits issued to those
13individuals. The Department shall further provide this data as
14part of its annual report to the General Assembly. The report
15shall exclude any personally identifiable information.
16    (h) Notwithstanding any other provision of this Code, and
17to the maximum extent permitted by federal law, for purposes
18of determining eligibility and the amount of other assistance
19under this Code, the Department of Human Services and local
20governmental units administering assistance under this Code,
21shall exclude from consideration any FRESH benefits provided
22under this Section.
23    (i) Program termination. The provisions of this Section
24are inoperative on and after July 1, 2027.
 
25    Section 99. Effective date. This Act takes effect upon
