| 1 | | of their SNAP benefits, or a reduction in their household's |
| 2 | | monthly SNAP benefit allotment, if the termination or |
| 3 | | reduction in SNAP benefits occurred as a result of the |
| 4 | | individual failing to meet federal SNAP work requirements. |
| 5 | | (c) Payment amount. Individuals eligible for FRESH |
| 6 | | benefits shall be provided a one-time lump sum payment equal |
| 7 | | to $600. Multiple individuals within the same SNAP household |
| 8 | | may receive FRESH benefits as set forth in subsection (e). |
| 9 | | (d) Issuance. |
| 10 | | (1) The Department of Human Services shall issue FRESH |
| 11 | | benefits to eligible individuals automatically. The |
| 12 | | Department shall not require any application, action, or |
| 13 | | additional information from eligible individuals to |
| 14 | | receive FRESH benefits. |
| 15 | | (2) Where the reduction or termination of SNAP |
| 16 | | benefits as set forth in subsection (b) occurred on or |
| 17 | | after May 1, 2026, but prior to the first of the month |
| 18 | | following the effective date of this amendatory Act of the |
| 19 | | 104th General Assembly, the Department shall provide FRESH |
| 20 | | benefits within 10 calendar days. |
| 21 | | (3) Where the reduction or termination of SNAP |
| 22 | | benefits as set forth in subsection (b) occurred on or |
| 23 | | after the first of the month following the effective date |
| 24 | | of this amendatory Act of the 104th General Assembly, the |
| 25 | | Department shall immediately issue FRESH benefits upon the |
| 26 | | effective date of the termination or reduction of SNAP |

| 1 | | benefits as set forth in subsection (b). |
| 2 | | (e) Individuals eligible for FRESH benefits shall be |
| 3 | | limited to one issuance of FRESH benefits per individual |
| 4 | | subject to a reduction or termination of SNAP benefits as set |
| 5 | | forth in subsection (b). Multiple individuals within the same |
| 6 | | SNAP household may receive FRESH benefits. |
| 7 | | (f) FRESH benefits under this Section shall be provided to |
| 8 | | eligible individuals in the form of cash benefits distributed |
| 9 | | via disbursement to an Electronic Benefit Transfer card. |
| 10 | | (g) Data reporting. The Department shall publish monthly |
| 11 | | data on the number of individuals who have received FRESH |
| 12 | | benefits and the amount of FRESH benefits issued to those |
| 13 | | individuals. The Department shall further provide this data as |
| 14 | | part of its annual report to the General Assembly. The report |
| 15 | | shall exclude any personally identifiable information. |
| 16 | | (h) Notwithstanding any other provision of this Code, and |
| 17 | | to the maximum extent permitted by federal law, for purposes |
| 18 | | of determining eligibility and the amount of other assistance |
| 19 | | under this Code, the Department of Human Services and local |
| 20 | | governmental units administering assistance under this Code, |
| 21 | | shall exclude from consideration any FRESH benefits provided |
| 22 | | under this Section. |
| 23 | | (i) Program termination. The provisions of this Section |
| 24 | | are inoperative on and after July 1, 2027. |
| 25 | | Section 99. Effective date. This Act takes effect upon |
