Provides that a public utility shall freeze its monthly customer charge for low-income households at an amount equal to a percentage of the household's income that is no greater than the current percentage of income used to determine the amount of monthly credits administered to participants of the Percentage of Income Payment Plan under the Energy Assistance Act. |

| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Public Utilities Act is amended by adding |
| 5 | | Section 9-241.5 as follows:
|
| 6 | | (220 ILCS 5/9-241.5 new) |
| 7 | | Sec. 9-241.5. Monthly customer charge freeze. |
| 8 | | (a) As used in this Section: |
| 9 | | "Customer charge" means a customer's fixed utility service |
| 10 | | costs, such as billing and meter readings, that do not vary |
| 11 | | with the customer's usage of the utility. |
| 12 | | "Low-income household" means a residential household with |
| 13 | | annual household income at or below 135% of the poverty |
| 14 | | guidelines updated periodically in the Federal Register by the |
| 15 | | U.S. Department of Health and Human Services under the |
| 16 | | authority of 42 U.S.C. 9902(2). |
| 17 | | (b) A public utility shall freeze its monthly customer |
| 18 | | charge for low-income households at an amount equal to a |
| 19 | | percentage of the household's income that is no greater than |
| 20 | | the current percentage of income used to determine the amount |
| 21 | | of monthly credits administered to participants of the |
| 22 | | Percentage of Income Payment Plan under subsection (c) of |
| 23 | | Section 18 of the Energy Assistance Act. |
