1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Radio and Television Grant Act is
5amended by changing Sections 0.01, 1, 2, 3, 4, 5, 6, 7, and 8
6as follows:

8    Sec. 0.01. Short title. This Act may be cited as the Public
9Media Public Radio and Television Grant Act.

12    Sec. 1. Definitions. As used in this Act, unless the
13context otherwise requires:
14    "Illinois public radio station" or "radio station" means a
15non-commercial public radio broadcasting station licensed as
16such by the Federal Communications Commission, or authorized
17under a program test authority by the Federal Communications
18Commission, which operates from a community located in this
19State, and meets the minimum criteria for receipt of Community
20Service Grants set by the Corporation for Public Broadcasting;
21and
22    "Illinois public television station" or "television

1station" means a non-commercial public television broadcasting
2station licensed as such by the Federal Communications
3Commission, or authorized under a program test authority by
4the Federal Communications Commission, which operates from a
5community located in this State, and meets the minimum
6criteria for receipt of Community Service Grants set by the
7Corporation for Public Broadcasting.
8    "Public, educational, and government access channel" or
9"PEG" means a cable-operated channel that provides community
10programming, such as coverage of hyper-local news, high school
11sports, and city council meetings.
12    "Eligible public media outlet" station" means a public,
13educational, and government access channel or public radio or
14television station as defined hereinabove which had been in
15full-time operation and has met the minimum grant criteria of
16the Corporation for Public Broadcasting before applying for a
17grant under this Act.
18    In the event the Corporation for Public Broadcasting
19should cease to exist, or its Community Service Grant program
20should terminate, or the eligibility criteria for grants under
21the Community Service Grant program shall be lowered, then the
22criteria for eligibility for such grants which were extant on
23the effective date of this Act shall prevail for purposes of
24this Act.
25    "Public media outlet" or "outlet", "Station" unless
26otherwise qualified, means any eligible PEG, radio station, or

1television station.
2    "Actual operating cost" means the total sum expended for
3the operations and maintenance of an Illinois public radio or
4television station.

7    Sec. 2. Certification process. Each eligible outlet
8station shall certify to the Illinois Arts Council, in such
9form and at such time as the Council shall require, its actual
10operating cost for the prior fiscal year. Upon acceptance by
11the Illinois Arts Council, such certification shall constitute
12the basis for grants provided under this Act.

15    Sec. 3. Allocation of Funds. Funds appropriated under this
16Act shall be used for the purpose of making grants to public
17media outlets. stations under this Act shall be divided into 2
18grant pools, with 75% of such appropriated funds constituting
19a grant pool for public television stations and 25% of such
20appropriated funds constituting a grant pool for public radio
21stations.

1    Sec. 4. Basic Grants. Each eligible outlet station shall
2receive an annual basic service grant in an amount equal to 30%
3of the grant pool for which it is eligible divided by the
4number of eligible outlets. stations.

7    Sec. 5. Operating Grants. Each eligible outlet station
8shall receive an annual operating support grant amounting to a
9pro-rata share of 70% of the grant pool for which it is
10eligible. This share shall bear the same ratio to 70% of the
11grant pool from which it came as the outlet's station's actual
12operating cost bore in the previous fiscal year to the
13aggregate of such actual operating cost for all eligible
14outlets stations for that year.

17    Sec. 6. Grant Limitations. Notwithstanding any other
18provision of this Act, no outlet station shall in any year be
19allocated funds under this Act in excess of one-half of its
20actual operating cost for the prior fiscal year. Those funds
21not obligated by virtue of this limitation shall be
22distributed to the remaining outlets stations in accordance
23with the provisions of Section 5 of this Act.
24    Notwithstanding any other provision of this Act, no outlet

1station shall be allocated more than 60% of all funds in its
2grant pool. Those funds not obligated by virtue of this
3limitation shall be distributed to the remaining eligible
4outlets stations in accordance with the provisions of Section
55 of this Act.

8    Sec. 7. Required Assurances. Each eligible outlet station
9and, if applicable, its outlet station licensee shall certify
10to the Illinois Arts Council when applying for grant funds
11under this Act that any funds received pursuant to the
12provisions of this Act shall not supplant or cause to be
13reduced any other sources of funding for such outlets
14stations, and will be used solely for the benefit of public
15media a public broadcasting station and not for general
16institutional overhead or parent organization expenses.

19    Sec. 8. Illinois Public Broadcasting Council. There is
20hereby created a public corporation to be called the Illinois
21Public Broadcasting Council whose directors shall consist of
22one representative of each outlet station eligible to receive
23grants under this Act. This Corporation shall function under
24such bylaws as shall be written by its initial directors and

1amended from time to time, provided, however, that such bylaws
2shall be in conformity with the applicable laws of the State of
3Illinois.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.
