| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Nursing Home Care Act is amended by adding |
| 5 | | Section 3-610.5 as follows:
|

| 7 | | Sec. 3-610.5. Incident and accident reporting. |
| 8 | | (a) Each facility shall notify the Department of any |
| 9 | | incident or accident that results in serious physical harm or |
| 10 | | injury to a resident or any situation in which a resident |
| 11 | | requires immediate medical attention, including admission to a |
| 12 | | hospital, as a direct result of an incident or accident. |
| 13 | | Nothing in this Section precludes reporting of suspected or |
| 14 | | alleged abuse or neglect that must be reported according to |
| 15 | | the Abused and Neglected Long Term Care Facility Residents |
| 16 | | Reporting Act. |
| 17 | | (b) Each facility shall, by phone, by fax, or through the |
| 18 | | Office of Health Care Regulation LLCS Portal, notify the |
| 19 | | appropriate regional office of the Department within 24 hours |
| 20 | | after each reportable incident or accident. The facility shall |
| 21 | | send a narrative summary of each reportable incident or |
| 22 | | accident to the Department within 5 business days after the |
| 23 | | incident or accident. |
