SYNOPSIS AS INTRODUCED:
 
15 ILCS 20/50-25

    Amends the State Budget Law of the Civil Administrative Code of Illinois. Sets forth additional requirements for the benefit cost analysis performed by the Budgeting for Results Commission as part of its annual report. Provides that the benefit cost analysis conducted for any crime prevention programs shall include data and information provided by crime prevention programs, victims rights groups, and law enforcement agencies in the State.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Budget Law of the Civil
5Administrative Code of Illinois is amended by changing Section
650-25 as follows:
 
7    (15 ILCS 20/50-25)
8    Sec. 50-25. Statewide prioritized goals.
9    (a) Definitions. As used in this Section:
10    "Commission" means the Budgeting for Results Commission
11established by this Section.
12    "Result area" means major organizational categories of
13State government as defined by the Governor.
14    "Outcome area" means subcategories of result areas that
15further define, and facilitate the measurement of the result
16area, as established by the Governor.
17    (b) Statewide prioritized goals. For fiscal year 2025 and
18each fiscal year thereafter, prior to the submission of the
19State budget, the Governor, in consultation with the
20Commission established under this Section, shall: (i) identify
21statewide result areas that are most important for each State
22agency of the executive branch under the jurisdiction of the
23Governor to achieve for the next fiscal year and (ii) identify

1outcome areas, which further define the statewide result
2areas, into which State programs and associated spending can
3be categorized. There must be a reasonable number of annually
4defined statewide result and outcome areas defining State
5priorities for the budget. Each result and outcome shall be
6further defined to facilitate success in achieving that result
7or outcome.
8    (c) Budgeting for Results Commission. On or after July 31,
92024, the Governor shall establish an advisory commission for
10the purpose of advising the Governor in the implementation of
11performance-based budgeting in Illinois State government,
12setting statewide result and outcome areas, and providing
13oversight and guidance for comprehensive program assessments
14and benefit-cost analysis of State agency programs.
15        (1) Membership. The commission shall be composed of
16    voting and non-voting members appointed by the Governor.
17    The commission shall be a well-balanced group and shall be
18    not more than 15 and not less than 8 members. Members
19    appointed by the Governor shall serve a three-year term,
20    beginning and ending on July 1 of each year. Vacancies in
21    Commission membership shall be filled in the same manner
22    as initial appointments. Appointments to fill vacancies
23    occurring before the expiration of a term shall be for the
24    remainder of the term. Members shall serve until their
25    successors are appointed.
26        (2) Bylaws. The commission may adopt bylaws for the

1    regulation of its affairs and the conduct of its business.
2        (3) Quorum. Total membership of the Commission
3    consists of the number of voting members serving on the
4    Commission, not including any vacant positions. A quorum
5    consists of a simple majority of total voting membership
6    and shall be sufficient to conduct the business of the
7    commission, unless stipulated otherwise in the bylaws of
8    the commission. A member may submit a proxy in writing to
9    the Commission Co-Chairs or the Commission Staff Director
10    no later than 24 hours before a scheduled meeting, and
11    that proxy shall count toward the quorum for that meeting
12    only.
13        (4) Chairpersons. Two Co-Chairs of the commission
14    shall be appointed by the Governor. The Co-Chairs shall be
15    one member of the General Assembly and one person who is
16    not a member of the General Assembly.
17        (5) Meetings. The commission shall hold at least 2
18    in-person public meetings during each fiscal year. One
19    meeting shall be held in the City of Chicago and one
20    meeting shall be held in the City of Springfield. The
21    commission may choose by a majority vote of its members to
22    hold one virtual meeting, which is open to the public and
23    over the Internet, in lieu of the 2 in-person public
24    meetings required under this Section.
25        (6) Compensation. Members shall not receive
26    compensation for their services.

1        (7) Annual report. By November 1 of each year, the
2    commission shall submit a report to the Governor and the
3    General Assembly setting forth recommendations with
4    respect to the Governor's implementation of
5    performance-based budgeting in Illinois State government.
6    The report shall be published on the Governor's Office of
7    Management and Budget's website. In its report, the
8    commission shall report on the status of comprehensive
9    program assessments and benefit cost analysis of state
10    agency programs conducted during the prior year. The
11    benefit cost analysis conducted under this paragraph shall
12    be truthful and accurate to the best of the commission's
13    ability. The benefit cost analysis conducted for any crime
14    prevention programs, including housing and employment
15    initiatives, shall include data and information provided
16    by crime prevention programs, victims rights groups, and
17    law enforcement agencies in this State. The benefit cost
18    analysis for crime prevention programs shall show
19    conclusively a reduction in crime to be considered a
20    success. The information provided to the commission shall
21    be made publicly available in the annual report if a
22    benefit cost analysis is conducted for any crime
23    prevention program. The annual report shall only make
24    recommendations for the continued use or the need of
25    reform a program if it is a crime prevention program.
26    The commission shall also review existing statutory

1mandates and include in its report recommendations for the
2repeal or modification of statutory mandates and funds or the
3State treasury which are out-of-date or unduly burdensome to
4the operations of State government.
5    The General Assembly may object to the commission's report
6by passing a joint resolution detailing the General Assembly's
7objections.
8    (d) In addition, each other constitutional officer of the
9executive branch, in consultation with the appropriation
10committees of the General Assembly, shall: (i) prioritize
11outcomes that are most important for his or her office to
12achieve for the next fiscal year and (ii) set goals to
13accomplish those outcomes according to the priority of the
14outcome. The Governor and each constitutional officer shall
15separately conduct performance analyses to determine which
16programs, strategies, and activities will best achieve those
17desired outcomes. The Governor shall recommend that
18appropriations be made to State agencies and officers for the
19next fiscal year based on the agreed upon result and outcome
20areas. Each agency and officer may develop its own strategies
21for meeting those goals and shall review and analyze those
22strategies on a regular basis. The Governor shall also
23implement procedures to measure annual progress toward the
24State's statewide results and outcomes and shall develop a
25statewide reporting system that collects performance data from
26all programs under the authority of the Governor. Those

1performance measures and results shall be posted on the
2Governor's Office of Management and Budget website.
