2025 and 2026 HB4944 Introduced , by Rep. Jay Hoffman SYNOPSIS AS INTRODUCED: | | | Amends the Criminal Code of 2012. Provides that any person, firm, corporation, co-partnership, limited liability company, association, or business, including an online retailer, that intentionally manufactures, delivers, possesses, or sells, with intent to manufacture, deliver, sell, or otherwise transfer nitrous oxide for the purpose of causing a condition of intoxication, elation, euphoria, dizziness, stupefaction, or dulling of the senses or for the purpose of changing, distorting, or disturbing the audio, visual, or mental processes is guilty of a Class 3 felony. |

| 1 | | AN ACT concerning criminal law. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Criminal Code of 2012 is amended by |
| 5 | | changing Section 24.5-10 as follows: |
| 6 | | (720 ILCS 5/24.5-10) |
| 7 | | Sec. 24.5-10. Unlawful manufacture, or delivery, or sale. |
| 8 | | Any person, firm, corporation, co-partnership, limited |
| 9 | | liability company, or association, or business, including an |
| 10 | | online retailer, that intentionally manufactures, delivers, or |
| 11 | | possesses, or sells with intent to manufacture, or deliver, |
| 12 | | sell, or otherwise transfer nitrous oxide for any purpose |
| 13 | | prohibited under Section 24.5-5 is guilty of a Class 3 felony. |
