| 1 | AN ACT concerning business. | ||||||
| 2 | Be it enacted by the People of the State of Illinois, | ||||||
| 3 | represented in the General Assembly: | ||||||
| 4 | Section 5. The Ticket Sale and Resale Act is amended by | ||||||
| 5 | adding Sections 0.5 and 1.6 as follows: | ||||||
| 6 | (815 ILCS 414/0.5 new) | ||||||
| 7 | Sec. 0.5. Definitions. As used in this Act: | ||||||
| 8 | "Reseller" or "ticket reseller" means a person engaged in | ||||||
| 9 | the resale of tickets. | ||||||
| 10 | "Ticket" means a physical, electronic, or other form of a | ||||||
| 11 | certificate, document, voucher, token, or other evidence | ||||||
| 12 | indicating that a person has the right to be admitted to an | ||||||
| 13 | event at a specific time for a specific seat or area. | ||||||
| 14 | "Ticket resale marketplace" means a person that operates a | ||||||
| 15 | platform or exchange for the resale of tickets between third | ||||||
| 16 | parties or between the ticket resale marketplace and a third | ||||||
| 17 | party. | ||||||
| 18 | (815 ILCS 414/1.6 new) | ||||||
| 19 | Sec. 1.6. Prohibition on selling tickets not in the | ||||||
| 20 | reseller's possession. | ||||||
| 21 | (a) A ticket reseller shall not sell or offer for sale a | ||||||
| 22 | ticket that the ticket reseller does not own or have actual or | ||||||

| 1 | constructive possession of at the time of listing or | ||||||
| 2 | advertising for sale. If a ticket is sold on a ticket resale | ||||||
| 3 | marketplace, the ticket resale marketplace shall ensure that | ||||||
| 4 | the ticket reseller is compliant with this subsection. | ||||||
| 5 | (b) A violation of this Section constitutes an unlawful | ||||||
| 6 | practice under the Consumer Fraud and Deceptive Business | ||||||
| 7 | Practices Act. All remedies, penalties, and authority granted | ||||||
| 8 | to the Attorney General by the Consumer Fraud and Deceptive | ||||||
| 9 | Business Practices Act shall be available to the Attorney | ||||||
| 10 | General for the enforcement of this Section. | ||||||
| 11 | Section 10. The Consumer Fraud and Deceptive Business | ||||||
| 12 | Practices Act is amended by adding Section 2MMMM as follows: | ||||||
| 13 | (815 ILCS 505/2MMMM new) | ||||||
| 14 | Sec. 2MMMM. Violations of the Ticket Sale and Resale Act. | ||||||
| 15 | Any person that violates Section 1.6 of the Ticket Sale and | ||||||
| 16 | Resale Act commits an unlawful practice within the meaning of | ||||||
| 17 | this Act. | ||||||
| 18 | Section 99. Effective date. This Act takes effect upon | ||||||
| 19 | becoming law. | ||||||
