| 4 | | "Section 5. The Ticket Sale and Resale Act is amended by |
| 5 | | adding Sections 0.5 and 1.6 as follows:

| 7 | | Sec. 0.5. Definitions. As used in this Act: |
| 8 | | "Reseller" or "ticket reseller" means a person engaged in |
| 9 | | the resale of tickets. |
| 10 | | "Ticket" means a physical, electronic or other form of a |
| 11 | | certificate, document, voucher, token, or other evidence |
| 12 | | indicating that a person has the right to be admitted to an |
| 13 | | event at a specific time for a specific seat or area. |
| 14 | | "Ticket resale marketplace" means a person that operates a |
| 15 | | platform or exchange for the resale of tickets between third |
| 16 | | parties or between the ticket resale marketplace and a third |

| 1 | | party.

| 2 | | (815 ILCS 414/1.6 new) |
| 3 | | Sec. 1.6. Prohibition on selling tickets not in the |
| 4 | | reseller's possession. |
| 5 | | (a) A ticket reseller shall not sell or offer for sale a |
| 6 | | ticket that the ticket reseller does not own or have actual or |
| 7 | | constructive possession of at the time of listing or |
| 8 | | advertising for sale. If a ticket is sold on a ticket resale |
| 9 | | marketplace, the ticket resale marketplace shall ensure that |
| 10 | | the ticket reseller is compliant with this subsection. |
| 11 | | (b) A violation of this Section constitutes an unlawful |
| 12 | | practice under the Consumer Fraud and Deceptive Business |
| 13 | | Practices Act. All remedies, penalties, and authority granted |
| 14 | | to the Attorney General by the Consumer Fraud and Deceptive |
| 15 | | Business Practices Act shall be available to the Attorney |
| 16 | | General for the enforcement of this Section.

| 17 | | Section 10. The Consumer Fraud and Deceptive Business |
| 18 | | Practices Act is amended by adding Section 2MMMM as follows:

| 20 | | Sec. 2MMMM. Violations of the Ticket Sale and Resale Act. |
| 21 | | Any person that violates Section 1.6 of the Ticket Sale and |
| 22 | | Resale Act commits an unlawful practice within the meaning of |
| 23 | | this Act.
