AMENDMENT TO HOUSE BILL 4984

2    AMENDMENT NO. ______. Amend House Bill 4984 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Ticket Sale and Resale Act is amended by
5adding Sections 0.5 and 1.6 as follows:
 
6    (815 ILCS 414/0.5 new)
7    Sec. 0.5. Definitions. As used in this Act:
8    "Reseller" or "ticket reseller" means a person engaged in
9the resale of tickets.
10    "Ticket" means a physical, electronic or other form of a
11certificate, document, voucher, token, or other evidence
12indicating that a person has the right to be admitted to an
13event at a specific time for a specific seat or area.
14    "Ticket resale marketplace" means a person that operates a
15platform or exchange for the resale of tickets between third
16parties or between the ticket resale marketplace and a third

1party.
 
2    (815 ILCS 414/1.6 new)
3    Sec. 1.6. Prohibition on selling tickets not in the
4reseller's possession.
5    (a) A ticket reseller shall not sell or offer for sale a
6ticket that the ticket reseller does not own or have actual or
7constructive possession of at the time of listing or
8advertising for sale. If a ticket is sold on a ticket resale
9marketplace, the ticket resale marketplace shall ensure that
10the ticket reseller is compliant with this subsection.
11    (b) A violation of this Section constitutes an unlawful
12practice under the Consumer Fraud and Deceptive Business
13Practices Act. All remedies, penalties, and authority granted
14to the Attorney General by the Consumer Fraud and Deceptive
15Business Practices Act shall be available to the Attorney
16General for the enforcement of this Section.
 
17    Section 10. The Consumer Fraud and Deceptive Business
18Practices Act is amended by adding Section 2MMMM as follows:
 
19    (815 ILCS 505/2MMMM new)
20    Sec. 2MMMM. Violations of the Ticket Sale and Resale Act.
21Any person that violates Section 1.6 of the Ticket Sale and
22Resale Act commits an unlawful practice within the meaning of
23this Act.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
