Provides that a detention center facility may not be located, constructed, or operated within 1,500 feet of the property boundaries of any school, day care center, day care home, cemetery, public park, forest preserve, public housing, private residence, or place of religious worship, regardless of address. Defines "detention center facility" and "federal immigration authority". Effective immediately. |

| 1 | | AN ACT concerning local government. |
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly: |
| 4 | | Section 5. The Illinois Municipal Code is amended by |
| 5 | | adding Section 11-5-12 as follows: |
| 6 | | (65 ILCS 5/11-5-12 new) |
| 7 | | Sec. 11-5-12. Detention center facilities. |
| 8 | | (a) In this Section: |
| 9 | | "Detention center facility" means any one or more of the |
| 10 | | following: |
| 11 | | (1) a facility that is owned, leased, operated, or |
| 12 | | otherwise controlled by a federal immigration authority |
| 13 | | and that has as its primary use the occupation under |
| 14 | | restraint or security of individuals detained by or in the |
| 15 | | custody of a federal immigration authority; |
| 16 | | (2) a facility where individuals who have been |
| 17 | | detained by or are in the custody of a federal immigration |
| 18 | | authority are processed for deportation from the United |
| 19 | | States; or |
| 20 | | (3) a facility where individuals who have been |
| 21 | | detained by or in the custody of a federal immigration |
| 22 | | authority are temporarily held while their citizenship |
| 23 | | status is determined. |
