AMENDMENT TO HOUSE BILL 5071

2    AMENDMENT NO. ______. Amend House Bill 5071 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Housing Development Act is
5amended by adding Section 7.34 as follows:
 
6    (20 ILCS 3805/7.34 new)
7    Sec. 7.34. Bilingual pay supplement. The Authority shall
8establish a special pay supplement for those positions of
9employment that require, pursuant to the Authority's official
10classification specification, that a person employed in that
11position speak or write a language other than English,
12including American Sign Language, to better serve limited
13English speakers across the State. Positions paid under this
14Section may be eligible for a bilingual pay supplement to
15attract bilingual individuals, to encourage present employees
16to become proficient in languages other than English, or to

1retain qualified bilingual employees.
2    The positions eligible for a bilingual pay supplement, the
3amount of the supplement, and the length of time it remains in
4effect shall be negotiated between the Authority and the
5appropriate collective bargaining representative as determined
6under the Illinois Public Labor Relations Act. The bilingual
7pay supplement may be negotiated for each foreign language,
8including American Sign Language, required for the position by
9the Authority's official classification specification.
10    A bilingual pay supplement shall be processed within 30
11calendar days after the employee presents to the Authority a
12certification from either: (i) the designated testing program
13process selected by the Authority; or (ii) a State community
14college confirming that language skill proficiency in reading,
15writing, and speaking has been satisfied by the employee.
 
16    Section 10. The Toll Highway Act is amended by changing
17Section 8 as follows:
 
18    (605 ILCS 10/8)  (from Ch. 121, par. 100-8)
19    Sec. 8. The Authority shall have the power:
20    (a) To acquire, own, use, hire, lease, operate and dispose
21of personal property, real property (except with respect to
22the headquarters building and surrounding land of the
23Authority located at 2700 Ogden Avenue, Downers Grove,
24Illinois, which may be sold or mortgaged only as provided in

1Section 7.5 of the State Property Control Act to the extent
2that such property is subject to the State Property Control
3Act at the time of the proposed sale), any interest therein,
4including rights-of-way, franchises and easements.
5    (b) To enter into all contracts and agreements necessary
6or incidental to the performance of its powers under this Act.
7All employment contracts let under this Act shall be in
8conformity with the applicable provisions of "An Act
9regulating wages of laborers, mechanics and other workers
10employed under contracts for public works," approved June 26,
111941, as amended.
12    (c) To employ and discharge, without regard to the
13requirements of any civil service or personnel act, such
14administrative, engineering, traffic, architectural,
15construction, and financial experts, and inspectors, and such
16other employees, as are necessary in the Authority's judgment
17to carry out the purposes of this Act; and to establish and
18administer standards of classification of all of such persons
19with respect to their compensation, duties, performance, and
20tenure; and to enter into contracts of employment with such
21persons for such periods and on such terms as the Authority
22deems desirable.
23    (d) To appoint by and with the consent of the Attorney
24General, assistant attorneys for such Authority, which said
25assistant attorneys shall be under the control, direction and
26supervision of the Attorney General and shall serve at his

1pleasure.
2    (e) To retain special counsel, subject to the approval of
3the Attorney General, as needed from time to time, and fix
4their compensation, provided however, such special counsel
5shall be subject to the control, direction and supervision of
6the Attorney General and shall serve at his pleasure.
7    (f) To acquire, construct, relocate, operate, regulate and
8maintain a system of toll highways through and within the
9State of Illinois. However, the Authority does not have the
10power to acquire, operate, regulate or maintain any system of
11toll highways or toll bridges or portions of them (including
12but not limited to any system organized pursuant to Division
13108 of Article 11 of the Illinois Municipal Code) in the event
14either of the following conditions exists at the time the
15proposed acquisition, operation, regulation or maintenance of
16such system is to become effective:
17    (1) the principal or interest on bonds or other
18instruments evidencing indebtedness of the system are in
19default; or
20    (2) the principal or interest on bonds or other
21instruments evidencing indebtedness of the system have been in
22default at any time during the 5 year period prior to the
23proposed acquisition.
24    To facilitate such construction, operation and maintenance
25and subject to the approval of the Division of Highways of the
26Department of Transportation, the Authority shall have the

1full use and advantage of the engineering staff and facilities
2of the Department.
3    (g) To establish a special pay supplement for those
4positions of employment that require, pursuant to the
5Authority's official classification specification, that a
6person employed in that position speak or write a language
7other than English, including American Sign Language, to
8better serve limited English speakers across the State.
9Positions paid under this paragraph may be eligible for a
10bilingual pay supplement to attract bilingual individuals, to
11encourage present employees to become proficient in languages
12other than English, or to retain qualified bilingual
13employees.
14    The positions eligible for a bilingual pay supplement, the
15amount of the supplement, and the length of time it remains in
16effect shall be negotiated between the Authority and the
17appropriate collective bargaining representative as determined
18under the Illinois Public Labor Relations Act. The bilingual
19pay supplement may be negotiated for each foreign language,

5calendar year and the needs of bilingual positions left
