SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Dissolution of Special Districts Act. Establishes a method for the dissolution of special districts. Provides that a special district may dissolve upon the affirmative majority vote of its own governing body and the affirmative majority vote of a receiving unit of local government. Provides that, on or before the date of dissolution, all real and personal property, and any other assets, together with all personnel, contractual obligations, and liabilities of the dissolving special district shall be transferred to the receiving unit of local government. Provides that, on the date of dissolution, the dissolving special district is dissolved. Provides that, on and after the date of dissolution, all rights and duties of the dissolving special district may be exercised by the receiving unit of local government. Provides that, before the date of dissolution, the receiving unit of local government shall submit a service continuation plan confirming that the receiving unit of local government has the resources to continue providing the services provided by the dissolving special district. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Dissolution of Special Districts Act.
 
6    Section 5. Applicability. The method of dissolution of a
7unit of local government under this Act shall be in addition to
8any other method of dissolving a unit of local government
9provided by law or otherwise.
 
10    Section 10. Definitions. As used in this Act:
11    "Date of dissolution" means the date that a dissolving
12special district is dissolved.
13    "Dissolving special district" means the special district
14proposed to be dissolved under this Act.
15    "Governing body" includes, but is not limited to, the
16board of a special district, the corporate authorities of a
17municipality, township board of a township, and the county
18board of a county.
19    "Receiving unit of local government" means the unit of
20local government receiving the rights, duties, and liabilities
21of the special district proposed to be dissolved under this
22Act.

1    Section 15. Requirements for dissolution. A special
2district shall be dissolved upon the affirmative vote of:
3        (1) a majority of the governing body of the dissolving
4    special district to dissolve the special district on a
5    specified date of dissolution and transfer the special
6    district's rights, duties, and liabilities to the
7    receiving unit of local government on or before a
8    specified date of dissolution; and
9        (2) a majority of the governing body of the receiving
10    unit of local government to receive the rights, duties,
11    and liabilities of the dissolving special district on or
12    before a specified date of dissolution.
 
13    Section 20. Dissolution; transfer of rights and duties.
14    (a) On or before the date of dissolution, all real and
15personal property, and any other assets, together with all
16personnel, contractual obligations, and liabilities of the
17dissolving special district shall be transferred to the
18receiving unit of local government.
19    (b) On the date of dissolution, the dissolving special
20district is dissolved.
21    (c) On and after the date of dissolution, all rights and
22duties of the dissolving special district may be exercised by
23the receiving unit of local government.

1    Section 25. Service continuation plan. Before the date of
2dissolution, the receiving unit of local government shall
3submit a service continuation plan confirming that the
4receiving unit of local government has the resources to
5continue providing the services provided by the dissolving
6special district.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
