AMENDMENT TO HOUSE BILL 5226

2    AMENDMENT NO. ______. Amend House Bill 5226 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-810.1 and 3-834 as follows:
 
6    (625 ILCS 5/3-810.1)  (from Ch. 95 1/2, par. 3-810.1)
7    Sec. 3-810.1. Tow truck; registration plates.
8    (a) Tow truck operators who hold a valid license or
9registration or certificate of exemption issued by the
10Illinois Commerce Commission registered under this Code may
11obtain registration plates for use as provided in this Code at
12the rate per set provided in subsection (a) of Section 3-815 of
13this Code for each vehicle so registered if: .
14        (1) in the case of a tow truck that is a light-duty tow
15    truck, the tow truck is equipped as a self-loader or a
16    flatbed truck;

1        (2) in the case of a tow truck that is a medium-duty
2    tow truck, the tow truck is equipped as a wrecker, a
3    flatbed, a self-loader, or a combination truck; and
4        (3) in the case of a tow truck that is a heavy-duty tow
5    truck or tractor, the vehicle is equipped as a wrecker
6    truck.
7    Upon revocation of a license or registration issued by the
8Illinois Commerce Commission, the tow truck operator shall
9immediately cease using and shall surrender the registration
10plates issued under this Section to the Secretary of State. If
11the holder of a certificate of exemption engages in non-exempt
12transportation, the Illinois Commerce Commission may revoke
13the certificate.
14    (b) As used in this Section:
15    "Light-duty tow truck" means a vehicle designed to safely
16transport vehicles weighing 8,000 pounds or less.
17    "Medium-duty tow truck" means a vehicle designed to safely
18transport vehicles weighing more than 8,000 pounds but less
19than 26,000 pounds.
20    "Heavy-duty tow truck or tractor" means a vehicle designed
21to safely transport vehicles weighing more than 26,000 pounds.
22    (c) A violation of this Section is a Class B misdemeanor.

1    (a) It is unlawful for any person to violate any of the
2provisions of this Chapter 3, except as provided in paragraph
3(b) of this Section and subsection (c) of Section 3-810.1,
4unless such violation is by this Code or other law of this
5State declared to be a felony.
6    (b) Except as provided in Section 3-810.1 of this Code,
7every Every person convicted of a misdemeanor for a violation
8of any of the provisions of this Chapter 3 for which another
9penalty is not provided shall for a first and second
10conviction be guilty of a petty offense; upon a third or
11subsequent conviction within one year after the first
12conviction such person shall be guilty of a Class C
13misdemeanor. Compliance with the registration provisions of
14this Code after apprehension or arrest shall not excuse
15imposition of the penalties herein provided nor be cause for
16dismissal of the arrest or of the summons nor be a basis for
17setting aside a conviction therefor.
