SYNOPSIS AS INTRODUCED:
 
60 ILCS 1/235-30 new

    Amends the Township Code. Provides that tentative budgets for specified road districts shall be subject to a public hearing and public inspection prior to adopting a budget and appropriation ordinance for road purposes. Provides that the township board may adopt all or part of the tentative budget and appropriation ordinance for road purposes and levy the amount determined by the board. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Township Code is amended by adding Section
5235-30 as follows:
 
6    (60 ILCS 1/235-30 new)
7    Sec. 235-30. Tentative budget and appropriation ordinance
8and tax for road purposes for townships in counties of more
9than 250,000 in habitants. In each road district comprised of
10a single township:
11        (1) The township board must hold a public hearing
12    before adopting a budget and appropriation ordinance for
13    road purposes.
14        (2) The township board must, at least 30 days before a
15    public hearing, prepare or cause to be prepared a
16    tentative budget and appropriation ordinance for road
17    purposes and file the ordinance with the township clerk.
18    The township clerk must make the tentative budget and
19    appropriation ordinance for road purposes available for
20    public inspection for at least 30 days before final action
21    on the ordinance. The required public hearing must be held
22    on or before the last day of the first quarter of the
23    fiscal year before the township board. Notice of the

1    hearing must be given by publication in a newspaper
2    published in the township at least 30 days before the time
3    of the hearing. If there is no newspaper published in the
4    township, notice of the public hearing may be given by
5    posting notices in 5 of the most public places in the
6    township. It is the duty of the township clerk to arrange
7    for the public hearing.
8        (3) The township board may adopt all or part of a
9    tentative budget and appropriation ordinance for road
10    purposes, as the township board deems necessary, and shall
11    levy the amount determined by the board and certify to the
12    county clerk the amount necessary to be raised by taxation
13    for road purposes as provided in Section 6-501 of the
14    Illinois Highway Code.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
