SYNOPSIS AS INTRODUCED:

50 ILCS 722/25

    Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board shall conduct or approve a training program in the identification of human remains for law enforcement officers employed by local law enforcement agencies. Amends the Missing Persons Identification Act. Provides that, if human remains are identified, then the assisting law enforcement agency shall provide all known aliases associated with the deceased person to the coroner or medical examiner.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Police Training Act is amended by
5adding Section 10.28 as follows:
 
6    (50 ILCS 705/10.28 new)
7    Sec. 10.28. Training; identification of human remains. The
8Board shall conduct or approve a training program in the
9identification of human remains for law enforcement officers
10employed by local law enforcement agencies. The purpose of the
11training provided under this Section shall be to teach law
12enforcement officers employed by local law enforcement
13agencies to identify human remains and respond appropriately.
 
14    Section 10. The Missing Persons Identification Act is
15amended by changing Section 25 as follows:

17    Sec. 25. Unidentified deceased persons.
18    (a) In this Section, "assisting law enforcement agency"
19has the meaning given to that term in Section 20.
20    (b) The coroner, medical examiner, or assisting law
21enforcement agency shall obtain a biological sample from any

1individual whose remains are not identifiable. The biological
2sample shall be forwarded to an accredited Combined DNA Index
3System (CODIS) laboratory where DNA profiles are entered into
4the appropriate State and National DNA Index System within 90
5days from the discovery of the remains. If the human remains
6are identified, then the assisting law enforcement agency
7shall provide all known aliases associated with the deceased
8person to the coroner or medical examiner.
9    Prior to the burial or interment of any unknown
10individual's remains or any unknown individual's body part,
11the medical examiner or coroner in possession of the remains
12or body part must assign a case number to the unknown
13individual or body part. The medical examiner or coroner shall
14place a stainless-steel tag that is stamped or inscribed with
15the assigned case number on the individual or body part and on
16the outside of the burial container.
