| 1 | | AMENDMENT TO HOUSE BILL 5588

| 2 | | AMENDMENT NO. ______. Amend House Bill 5588 on page 1, by |
| 3 | | replacing lines 8 through 22 with the following: |
| 4 | | "(1) restorative justice processes repair harm, |
| 5 | | improve community safety, and reduce recidivism by |
| 6 | | centering the needs of impacted persons, community |
| 7 | | members, and those who cause harm; |
| 8 | | (2) restorative justice processes should be |
| 9 | | implemented to promote equity in access, reduce |
| 10 | | disparities in criminal legal system involvement, and |
| 11 | | build community capacity; |
| 12 | | (3) community-based restorative justice practitioners |
| 13 | | and impacted persons are essential partners in the design, |
| 14 | | implementation, and accountability of Restorative Justice |
| 15 | | Community Courts; and |
| 16 | | (4) Restorative Justice Community Courts, as pioneered |
| 17 | | by the Circuit Court of Cook County, have demonstrated |
| 18 | | effectiveness in resolving eligible cases through |

| 1 | | voluntary, structured, community-based processes. |
| 2 | | The General Assembly further finds that, once a criminal |
| 3 | | case is filed, the management, adjudication, and disposition |
| 4 | | of that case are core judicial functions under Article VI of |
| 5 | | the Illinois Constitution, and that referral to a Restorative |
| 6 | | Justice Community Court constitutes a judicial determination |
| 7 | | regarding case resolution within the judicial branch."; and |
| 8 | | on page 5, line 1, by inserting after "admission." the |
| 9 | | following: |
| 10 | | "Nothing in this Section alters the authority of the State's |
| 11 | | Attorney to initiate criminal charges or to prosecute a case; |
| 12 | | referral to a Restorative Justice Community Court concerns |
| 13 | | only the judicial management and disposition of a filed |
| 14 | | case."; and |
| 15 | | on page 5, line 3, by inserting ", pursuant to court order, and |
| 16 | | shall remain subject to judicial supervision and final |
| 17 | | disposition by the court" after "post-adjudication"; and |
| 18 | | on page 7, line 2, by inserting "and that dismissal serves the |
| 19 | | interests of justice and public safety," after "Agreement,". |
