| 1 | HOUSE RESOLUTION | ||||||
| 2 | WHEREAS, Our state democracy, with policies and laws that | ||||||
| 3 | come from the will of the people of Illinois, is under threat | ||||||
| 4 | from a presidential administration that disregards the voice | ||||||
| 5 | of the people and steps on our rights daily; and | ||||||
| 6 | WHEREAS, The State of Illinois and its citizens cherish | ||||||
| 7 | the fundamental liberties guaranteed by the U.S. Constitution | ||||||
| 8 | and the Illinois Constitution, including due process, equal | ||||||
| 9 | protection, and freedom from unlawful government intrusion; | ||||||
| 10 | and | ||||||
| 11 | WHEREAS, In these last ten months of constant attacks by a | ||||||
| 12 | presidential administration that disregards our rights, our | ||||||
| 13 | freedoms, and our democracy in Illinois, the most effective | ||||||
| 14 | way to safeguard our freedoms has often been in court, | ||||||
| 15 | appealing to the judiciary; and | ||||||
| 16 | WHEREAS, The Office of the Illinois Attorney General, led | ||||||
| 17 | by Attorney General Kwame Raoul, along with his tireless | ||||||
| 18 | staff, has demonstrated extraordinary devotion, leadership, | ||||||
| 19 | and perseverance in the courts to protect our democracy, | ||||||
| 20 | freedoms, and civil liberties when threatened by federal | ||||||
| 21 | attacks; and | ||||||

| 1 | WHEREAS, The Office of the Illinois Attorney General has | ||||||
| 2 | taken bold legal steps to defend the interests of Illinois and | ||||||
| 3 | its residents and has served as one of the most effective | ||||||
| 4 | tactical instruments of the State of Illinois in securing | ||||||
| 5 | protection of our rights; and | ||||||
| 6 | WHEREAS, Among those critical court-based actions is the | ||||||
| 7 | lawsuit filed by the Office of the Illinois Attorney General, | ||||||
| 8 | Illinois v. Trump, in which the State challenged the Trump | ||||||
| 9 | administration's attempted deployment and federalization of | ||||||
| 10 | the National Guard in Illinois without proper justification, a | ||||||
| 11 | challenge of far-reaching and historic significance to | ||||||
| 12 | blocking the forced invasion of our land by federal agents and | ||||||
| 13 | preserving state sovereignty; and | ||||||
| 14 | WHEREAS, The Office of the Illinois Attorney General has | ||||||
| 15 | pursued or joined litigation to protect Illinoisans from | ||||||
| 16 | unlawful conditions on federal funding, to defend | ||||||
| 17 | immigration-related safeguards, to preserve state and local | ||||||
| 18 | authority, and, in dozens of other cases, to uphold the rule of | ||||||
| 19 | law, not the whims of the current presidential administration; | ||||||
| 20 | and | ||||||
| 21 | WHEREAS, It is fitting and proper that the Illinois House | ||||||
| 22 | of Representatives publicly acknowledges and commends these | ||||||
| 23 | efforts, as they have benefited all the people of Illinois and | ||||||

| |||||||
| 1 | strengthened the bonds of trust between our citizens and their | ||||||
| 2 | public institutions; therefore, be it | ||||||
| 3 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
| 4 | HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
| 5 | we recognize and express our gratitude to the Office of the | ||||||
| 6 | Illinois Attorney General and Attorney General Kwame Raoul for | ||||||
| 7 | their exceptional devotion, leadership, and perseverance in | ||||||
| 8 | defending our democracy and our freedoms through the courts; | ||||||
| 9 | and be it further | ||||||
| 10 | RESOLVED, That we acknowledge that the most effective | ||||||
| 11 | instrument for the protection of our democracy and our civil | ||||||
| 12 | liberties in the last nine months has been litigation, and | ||||||
| 13 | that the Attorney General and his team have been incredibly | ||||||
| 14 | effective in their defense of our democracy; and be it further | ||||||
| 15 | RESOLVED, That we recognize the Office of the Illinois | ||||||
| 16 | Attorney General's filing of a lawsuit against the Trump | ||||||
| 17 | administration to stop the unlawful deployment of the National | ||||||
| 18 | Guard in Illinois, challenging federal invocation of 10 U.S.C. | ||||||
| 19 | § 12406, the Posse Comitatus Act, and the Tenth Amendment, is a | ||||||
| 20 | case of national significance in protecting state sovereignty | ||||||
| 21 | and civil liberties; and be it further | ||||||
| 22 | RESOLVED, That we encourage the Office of the Illinois | ||||||

| 1 | Attorney General to continue steadfastly engaging in | ||||||
| 2 | litigation as necessary to uphold our democracy and our | ||||||
| 3 | freedoms; and be it further | ||||||
| 4 | RESOLVED, That suitable copies of this resolution be | ||||||
| 5 | delivered to Attorney General Kwame Raoul and the Office of | ||||||
| 6 | the Illinois Attorney General. | ||||||
