HOUSE RESOLUTION

 
2    WHEREAS, Our state democracy, with policies and laws that
3come from the will of the people of Illinois, is under threat
4from a presidential administration that disregards the voice
5of the people and steps on our rights daily; and
 
6    WHEREAS, The State of Illinois and its citizens cherish
7the fundamental liberties guaranteed by the U.S. Constitution
8and the Illinois Constitution, including due process, equal
9protection, and freedom from unlawful government intrusion;
10and
 
11    WHEREAS, In these last ten months of constant attacks by a
12presidential administration that disregards our rights, our
13freedoms, and our democracy in Illinois, the most effective
14way to safeguard our freedoms has often been in court,
15appealing to the judiciary; and
 
16    WHEREAS, The Office of the Illinois Attorney General, led
17by Attorney General Kwame Raoul, along with his tireless
18staff, has demonstrated extraordinary devotion, leadership,
19and perseverance in the courts to protect our democracy,
20freedoms, and civil liberties when threatened by federal
21attacks; and

1    WHEREAS, The Office of the Illinois Attorney General has
2taken bold legal steps to defend the interests of Illinois and
3its residents and has served as one of the most effective
4tactical instruments of the State of Illinois in securing
5protection of our rights; and
 
6    WHEREAS, Among those critical court-based actions is the
7lawsuit filed by the Office of the Illinois Attorney General,
8Illinois v. Trump, in which the State challenged the Trump
9administration's attempted deployment and federalization of
10the National Guard in Illinois without proper justification, a
11challenge of far-reaching and historic significance to
12blocking the forced invasion of our land by federal agents and
13preserving state sovereignty; and
 
14    WHEREAS, The Office of the Illinois Attorney General has
15pursued or joined litigation to protect Illinoisans from
16unlawful conditions on federal funding, to defend
17immigration-related safeguards, to preserve state and local
18authority, and, in dozens of other cases, to uphold the rule of
19law, not the whims of the current presidential administration;
20and
 
21    WHEREAS, It is fitting and proper that the Illinois House
22of Representatives publicly acknowledges and commends these
23efforts, as they have benefited all the people of Illinois and

1strengthened the bonds of trust between our citizens and their
2public institutions; therefore, be it
 
3    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
4HUNDRED FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
5we recognize and express our gratitude to the Office of the
6Illinois Attorney General and Attorney General Kwame Raoul for
7their exceptional devotion, leadership, and perseverance in
8defending our democracy and our freedoms through the courts;
9and be it further
 
10    RESOLVED, That we acknowledge that the most effective
11instrument for the protection of our democracy and our civil
12liberties in the last nine months has been litigation, and
13that the Attorney General and his team have been incredibly
14effective in their defense of our democracy; and be it further
 
15    RESOLVED, That we recognize the Office of the Illinois
16Attorney General's filing of a lawsuit against the Trump
17administration to stop the unlawful deployment of the National
18Guard in Illinois, challenging federal invocation of 10 U.S.C.
19§ 12406, the Posse Comitatus Act, and the Tenth Amendment, is a
20case of national significance in protecting state sovereignty
21and civil liberties; and be it further
 
22    RESOLVED, That we encourage the Office of the Illinois

1Attorney General to continue steadfastly engaging in
2litigation as necessary to uphold our democracy and our
3freedoms; and be it further
 
4    RESOLVED, That suitable copies of this resolution be
5delivered to Attorney General Kwame Raoul and the Office of
6the Illinois Attorney General.
