| 2 | | AMENDMENT NO. ______. Amend Senate Bill 141 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Department of Transportation Law of the |
| 5 | | Civil Administrative Code of Illinois is amended by changing |
| 6 | | Section 2705-275 as follows:
|
| 7 | | (20 ILCS 2705/2705-275) (was 20 ILCS 2705/49.25j) |
| 8 | | Sec. 2705-275. Grants for airport facilities. |
| 9 | | (a) In this Section, "project labor agreement" has the |
| 10 | | meaning given in the Project Labor Agreements Act. |
| 11 | | (b) The Department may make grants to municipalities and |
| 12 | | airport authorities for the renovation, construction, and |
| 13 | | development of airport facilities. A grant made under this |
| 14 | | Section must include a condition that the renovation, |
| 15 | | construction, and development of airport facilities is covered |
| 16 | | by a project labor agreement entered into with the local |

| 1 | | building and construction trades council having geographic |
| 2 | | jurisdiction over the airport facilities; except that a |
| 3 | | component of the construction, renovation, or demolition work |
| 4 | | may be excluded from the project labor agreement if the work |
| 5 | | performed for such an excluded component is performed under a |
| 6 | | collective bargaining agreement with one or more local unions |
| 7 | | that are affiliated with the same international union that is |
| 8 | | a member union of the local building and construction trades |
| 9 | | council having geographic jurisdiction over the airport |
| 10 | | facilities and signatory to the project labor agreement. The |
| 11 | | grants may be made from funds appropriated for that purpose |
| 12 | | from the Build Illinois Bond Fund. |

| 14 | | Section 10. The Airport Authorities Act is amended by |
| 15 | | adding Section 15.3 as follows:

| 17 | | Sec. 15.3. Project Labor Agreement. |
| 18 | | (a) In this Section, "project labor agreement" has the |
| 19 | | meaning given in the Project Labor Agreements Act. |
| 20 | | (b) Any contract entered into by an Airport Authority to |
| 21 | | construct, develop, expand, extend, or improve any airport or |
| 22 | | airport facility must include a requirement that any |
| 23 | | construction, renovation, or demolition work performed under |
| 24 | | the contract be covered by a project labor agreement entered |

| 1 | | into with the local building and construction trades council |
| 2 | | having geographic jurisdiction over the airport or airport |
| 3 | | facility; except that a component of the construction, |
| 4 | | renovation, or demolition work may be excluded from the |
| 5 | | project labor agreement if the work performed for such an |
| 6 | | excluded component is performed under a collective bargaining |
| 7 | | agreement with one or more local unions that are affiliated |
| 8 | | with the same international union that is a member union of the |
| 9 | | local building and construction trades council having |
| 10 | | geographic jurisdiction over the airport or airport facility |
| 11 | | and signatory to the project labor agreement.

| 12 | | Section 90. The State Mandates Act is amended by adding |
| 13 | | Section 8.49 as follows:
|
| 14 | | (30 ILCS 805/8.49 new) |
| 15 | | Sec. 8.49. Exempt mandate. Notwithstanding Sections 6 and |
| 16 | | 8 of this Act, no reimbursement by the State is required for |
| 17 | | the implementation of any mandate created by this amendatory |
| 18 | | Act of the 104th General Assembly.". |
