SYNOPSIS AS INTRODUCED:
 
410 ILCS 320/1  from Ch. 111 1/2, par. 4801

    Amends the Prenatal Syphilis Act. Deletes provisions requiring certain serological tests to be made free of charge by the Department of Public Health or the health departments of municipalities maintaining laboratories for the testing of blood specimens of any woman who resides in the municipality.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Prenatal Syphilis Act is amended by
5changing Section 1 as follows:
 
6    (410 ILCS 320/1)  (from Ch. 111 1/2, par. 4801)
7    Sec. 1. Every physician, or other person, attending in a
8professional capacity a pregnant woman in Illinois, shall take
9or cause to be taken a sample of blood of such woman at the
10time of the first examination, and a second sample of blood
11shall be taken or caused to be taken during the third trimester
12of pregnancy. These blood specimens shall be submitted to a
13laboratory approved by the Department of Public Health for a
14serological test for syphilis approved by the State Department
15of Public Health. In the event that any such blood test shall
16show a positive or doubtful result an additional test or tests
17shall be made. Such serological test or tests shall, upon
18request of any physician, be made free of charge by the State
19Department of Public Health or the Health Departments of
20cities, villages and incorporated towns maintaining
21laboratories for the testing of blood specimens of any woman
22who resides in that city, village or incorporated town.
23    The provisions of this Section shall not apply to any

1woman who objects to such serological tests on the grounds
2that such tests are contrary to her religious beliefs and
3practices.
